<br />79--~(j~5~~ <br />SURVIVORSHIP WARRANTY DEED <br />FRED EICAHOFF and DOROTHY EICKHOFF, husband and wife, herein <br />called the Grantars, in consideration of One Dollar and other <br />good and `ficient consideration .received from Grantees, do <br />grant, bargain, sell, convey and confirm unto FRED A. EICKHOFF <br />and DEBRA EICKHOr^F, husband and wife, as joint tenants with right <br />of survivorship and not as tenants in common, herein called the <br />Grantees, the _`ollowing-described real estate in Hall County, <br />Nebraska: <br />A tract of land in the South Half of the Northwest <br />Quarter iS~ATW'i) of Section Twenty-three (23), Township <br />Ten (20) North, Range Twelve (12) West, Hall County, <br />Nebraska, described as follows: Cammencing at the <br />point where the north line of the South Half of said <br />Northwest Quarter intersects with the east boundary <br />line of the public road located on the west side of <br />said Section Twent}•-three Q23i as the point of <br />beginning; rurning thence south along the east boundary <br />line of said public road a distance of 643.5 feet; <br />thence east on a Iine parallel to the north side of <br />said South Half of the Northwest Quarter (S~NW~) a <br />distance of 495 feet; thence north en a line parallel <br />to the east Iine of said public road located on the <br />west side of Section Twenty-three (23) a distance of <br />643.5 feet to the north boundary of said South Half of <br />the northwest Quarter (S~Iv'Ty3g) ; thence west a distance <br />of 495 feet to the point of beginning, cantaining 7.31 <br />acres, a little mcre or Iess. <br />Grantars reserve an easement over the westerly 16 feet of <br />the tract being conveyed by this deed from a point commencing ten <br />feet north of the present irrigation well located thereon and <br />extending south to the south line of said tract for so long as <br />said well, or any replacement thereof, is in its present location <br />and to run laterals or wipes from said well to the south for <br />irrigating, together wiL*~ the right of ingress and egress for <br />purposes of operating, maintaining, repairing or replacing the <br />well, Bump or motor, or any part thereof, and the iarerals oz <br />pipes used for transporting water for irrigation purposes. <br />TO HAVE AND TO FOLD the above-described premises together <br />with ail tenements, hereditaments and appurtenances thereto <br />belonging unto the Grantees and to their assigns, or to the heirs <br />and assigns of the survivor of them forever. <br />And Grantors do hereby cavenant with the Grantees that <br />Grantors are lawfull}= seized of said premises; that they are free <br />from encumbrance, but subject to wry easements, rights-of-way or <br />restrictions of record; that Grantors have goad right and lawful <br />authority to convey the same; and that Grantors warrant and wi21 <br />dafend t_he title _o said ~..._ses against the tayaful claims of <br />all oersens whomsoever. <br />It is the intention of all parties hereto that in the event <br />of the death of either of the Grantees: the entire fee simple <br />title to the real estate shall vest in the surviving Grantee. <br />Dated 3uly ~':-s; 2979. <br />r <br />- - _ -, j Fred Eickho_°f <br />="~ ~ "Grantor5~ <br />STATEf~ENT R7TACti~O -1 <br />
