<br />State of Colorado, Personal Representative of the
<br />t e~ma Taller, deceased, late of Wood River, in the county of
<br />a11, State of Nebraska, party of the first part; and ROGER W. LYDICK
<br />AA?D DEBORAH D. LYDICK, husband and wife, as joint tenants with right
<br />of survivorship, and not as tenants in common, of :Vood River, in the
<br />county of Hall, State of Nebraska, party of the second part,
<br />WITNESSETH:
<br />That the said party of the first part, the duly appointed,
<br />qualified and acting Personal Representative of said Alma Tuller,
<br />deceased, pursuant to appointment by the County Court of Hall County,
<br />Nebraska, by virtue o£ the power and authority, granted and conferred
<br />upon him by Order of the County Court to sell the real estate described
<br />herein, and in consideration of the sum of One and NoJ100 Dollars
<br />($1.00) to him paid by the party of the second part, the raceipt
<br />whereof is hereby confessed and acknowledged, does by these presents
<br />grant, bargain, sell, remise, release, alien, convey and confirm unto
<br />the party of the second part, and to their heirs and assigns forever,
<br />all of the following described tract of land, situate, lying and being
<br />in the county of Hall, State of Nebraska, to-wit:
<br />Lot Ten (10), Block Three (3), Dodd and
<br />Marshall's Addition to Wood River, Hall
<br />County, Nebraska,
<br />together with ali and singular the tenements, hereditaments and
<br />aapur*.enances thereunto belonging ar in anywise appertaining; and also
<br />all the estate, right, title, interest, property, possession, claim
<br />and demand whatsoever, which the said deceased had in her lifetime,
<br />and at the time of her decease, and which the said party of the first
<br />Bart has, by virtue of the said Order of the County Court, or otherwise,
<br />of, in or to the above granted premises, and every part and parcel
<br />thereof, with the appurtenances. To have and to hold the said premises,
<br />the tract of land aforesaid, with the hereditament.s and appurtenances
<br />thereof, unto the said party of the second part, their heirs and
<br />assicns, forever.
<br />And the said party of the first part, for himself, his
<br />heirs, executors and administrators, does covenant, promise and undertake
<br />to and with the said party of the second part, their heirs and assigns,
<br />that he is lawfully the Personal Representative of the Estate of said
<br />Alma Tuller; deceased, and has power to convey as aforesaid, and has
<br />in all respects acte3, in making this conveyance, in pursuance of the
<br />authority granted in and by Order of the County Court, dated April 25,
<br />1979; and that he has not made, done or suffered any act, matter or
<br />thing whatsoever, since he was Personal Representative as aforesaid,
<br />whereby the above granted premises, or any part thereof, are, shall or
<br />may be impeached, charged or incumbered, in any manner whatsoever.
<br />It is the intention of all parties hereto that in the event.
<br />of the death of either of the grantees, the entire fee simple title
<br />to the said rea3 estate s'raall vest in the surviving grantee.
