<br />79-~ ~t~~~40 <br />dimensions, and proposes to cause the plat of such subdivision when <br />finally approved by the Regional Planning Commission and the City Council <br />to be acknowledged by such owners, certified as to accuracy of survey by <br />a registered land surveyor, and to contain a dedication of streets to <br />the benefit of the public and of easements to the use of public utilities. <br />In consideration of the acceptance of the plat of Spelts-Schultz Industrial <br />Subdivision, the Subdivider hereby consents and agrees with the City of <br />Grand Island, Nebraska, that it will install or provide at its expense <br />the following improvements: <br />1. Paving. The Subdivider agrees to waive any right of protests <br />to any repaving district involving Webb Road where it abuts said sub- <br />division. The Subdivider acknowledges access for Lot One (1) to Old <br />LT. S. Highway 3~ in accordance wi*_h an agreement with the State of Nebraska <br />entered into between the parties on property for the widening of L'. S, <br />llighway 281 was acquired by the State. <br />2. Water. Water service is available to all lots in said subdivision, <br />subject to connection fees. <br />3. Sanitary Sewer. Sanitary sewer service is available to Lot Two <br />(2) in said subdivision. Accordingly, Lot One (1} is hereby authorized <br />the use of private septic tanks facilities. The Subdivider waives any <br />right to protest the creation of a sanitary sewer main dis*_rict, and <br />further agrees to connect all structures within said subdivision to said <br />sanitary sewer main within one construction season after said sewer ser- <br />vice becomes available to the respective lots. <br />4. LTtiiities Easement. The Subdivider agrees to dedicate a <br />sixteen {16) foot wide utilities easement on Lot One {1} of said subdivision <br />for general utility purposes as set forth on the official plat of said <br />subdivision. <br />5. Storm Drainage, A barrow pit has been excavated upon a portion <br />of Lot One (1) of said Subdivision, Said barrow pit shall be used as a <br />temporary storm water detention cell. Real estate of said subdivision <br />as indicated in Exhibit "A" shall be reserved for a permanent storm water <br />detention cell, with the City of Grand Island retaining a right of first <br />refusal to purchase said reserved property for said detention cell.
