79- t~(~ 3708 ~~ ~,~ ~~_~ ~.. <br />LICENSE AGREEMENT <br />THIS AGREEMENT entered into this // day of Af `/tee., 1979, by <br />and between the City of Grand Island, a municipal corporation, hereinafter <br />referred to as City, and Don Hoffman of Grand Island, Hall County, <br />Nebraska, hereinafter referred to as the Licensee. <br />WZTNESSETH: <br />WHEREAS, the Licensee is the owner of real estate located on Lot 15, <br />West Heights Addition to the City of Grand Island, located at the inter- <br />section of Fourth Street and Sherman Avenue; and <br />WHEREAS, the Licensee has placed or. said property a metal building <br />cn ~ ..,,..^,rote foundation of dimensions of IS feat by 14 fee and <br />WHEREAS, upon recent survey it has been determined that sal-d <br />building encroaches upon public right-of-way on Sherman Avenue. <br />NOW, THEREFORE, in consideration of the mutual covenants herein <br />contained, the parties agree as follows: <br />1. The City hereby grants a license to the Licensee to maintain <br />the aforesaid metal building on concrete foundation in public right-of- <br />aay kn~.~ci as Sherman Avenue not to extend ;ore than three feet into <br />said right-of-way. <br />2. It is understood and agreed that the Licensee can maintain said <br />encroachment in the public right-of-way at his own risk. The Licensee <br />hereby waives any claim for damages against the City of Grand Island, its <br />officers, agents, and employees, and independent contractors for any <br />damage or injury that may result to said improvement being located in the <br />City street right-of-way. <br />3. The Licensee shall indemnify and hold harmless the City from <br />and against any and all loss and damage and any and all claims, demands, <br />suits, liabilities, and payments in contract or tort, penal or otherwise, <br />resulting from or in respect of the Licensee's use of the City street <br />right-of-way for the aforesaid encroachment. <br />4. This license shall take effect immediately upon the date of <br />the last party executing this agreement, and shall continue for an <br />indefinite term; provided, that either party may terminate this agree- <br />. went at any time by giving the other party six months written notice. <br />- 1 - <br />
