<br />RELEASE OF MEMORANDUM AGREEMENT
<br />WHEREAS, the parties hereto, on August 14, 1973, entered
<br />into a Memorandum Agreement, recorded in Book 25 of Misc. Records.
<br />at Page 391, Register of Deeds, Hall County, Nebraska; and
<br />WHEREAS, the parties hereto desire to terminate and re-
<br />1eas~ the Memorandum Agreement between the two of them.
<br />NOW, 'THEREF'ORE, for valuable consideration, ~i1e receipt
<br />of which is hereby acknowledged, the parties hereto agree that
<br />the Memorandum Agreement dated August 14, 1973 between The
<br />Charles Machine Works, Inc., an Oklahoma corporation, and
<br />Ditch Witch of Nebraska, Inc., and recorded September 7, 1973
<br />in Book 25 of Misc. Records, Fage 391, Register of Deeds,
<br />Hall County, Nebraska, is hereby terminated and forever released.
<br />In addition, The Charles Machine Works, Inc., an Oklahoma
<br />corporation, hereby quitclaims, grants, bargains, sells, conveys
<br />and confirms unto Citch Witch of Nebraska, Inc, all of its right,
<br />title and interest in and to the following described real estate:
<br />1'he Easterly three (3) acres of the Southerly eight
<br />(8) acres, a little more or less, of the Northeast
<br />Quarter (NE ;) of the Northeast Quarter (NE 4) of
<br />Section 33, fiownship 11 North, Range 4, West o~ the
<br />6th P.M. Halt County, Nebraska; and,
<br />Three {3) acres of the Southerly eight {$) acres, a
<br />little more or less, of the Northeast Quarter {NE's)
<br />of the Northeast Quarter {NE~) of Section 33, Town-
<br />ship LI North, Range 9, West of the 6th P.M; Hali
<br />County, Nebraska, more particularly described as
<br />follows:
<br />Starting at a point on the South line of said
<br />Northeast Quarter {NE's) of the Northeast Quarter
<br />(NE's), said point being 330 feet East of the Sauth-
<br />west corner of said Northeast Quarter {NEB) of the
<br />Northeast Quarter {NEB), thence East 495 faet, and
<br />to the Southwest corner of the tract conveyer: to
<br />Mortgagor by deed recorded in Book 153 of deeds, page
<br />559, thence North 264 feet, thence West 495 feet to
