79-- U Cr 3 4 f3 6 RELEASE OF MORTGAGE THIS RELEASE OF MORTGAGE, executed by bfELLON BANK, N.A. {formerly Mellon National. Bank and Trust Company), hereinafter referred to as "the Trustee", and N. R. SMITH, successor individual trustee to D. A. HAZLETT, hereinafter referred to as "the Individual Trustee", in favor of DERBY REALTY CORPORATION, hereinafter referred to as "the Company"; WITNESSETH: THAT, WHEREAS, under date of May 15, 1967, the Company executed and delivered to Mellon National Bank and Trust Company and D. A. Hazlett, as trustees, that certain Indenture of Mortgage and Deed of Trust covering, with other groperty, the following-described real property situate in Hall County, Nebraska, to-wit: The West 14$.5 feet of Lot Fourteen (14) of Vantine Subdivision, located on part of the Northwest Quarter {NW/4) of Section 22, Township 11 North, Range 9 West of the bth P.M., which said Indenture of Mortgage and Deed of Trust is recorded in the office of the Register of Deeds of said county in Book 143 at page 219; and WHRRFA~, that portion of the total indebtedness seeured by said Indenture of Mortgage and Deed of Trust which has been allocable to the above-described real property. has been paid. NOW, THEREFORE, for and in consideration of the premises and for the purpose of releasing the lien of the aforesaid Indenture of Mortgage and Deed of Trust insofar as the above-described real property is concerned, the Trustee and the Individual Trustee do hereby and by these presents fully release the lien of said Indenture of Mortgage and Deed of Trust insofar, and insofar only, as the same has heretofore affected the above-described real property. Zt is an express condition of this release, and by accepting delivery of this release the Company agrees to said condition, that the lien of the aforesaid Indenture of Mortgage and Deed of Trust as the same has heretofore affected the properties therein described, other than the above-described real property, shall remain unaffected by the execution and delivery of this release.
