79-UU3485 ASSIGNMENT OF LEASE THIS ASSIGNMENT OF LEASE, executed by MELLON BANK, N.A. (formerly Mellon National Bank and Trust Company), and N. R. SMITH (successor individual trustee to D. A. Hazlett), hereinafter referred to as "the Trustees", in favor of DERBY REALTY CORPORATION, hereinafter referred to as n~mp~y~, WITNESSETH: THAT, WHEREAS, under date of May 15, 1967, the Company executed and delivered to Mellon National Bank and Trust Company and D. A. Hazlett, as trustees, an instrument entitled Assignment of Lease and Agreement, which said instrument is recorded in the office of the Register of Deeds of Hall County, >?~braska, in Book 16 at page 398; and WHEREAS, the execution and delivery of said Assignment of Lease and Agreement effected an assignment from the i;ompany to said trustees of the lessor's interest in and to tha*_ certain Lease of even date therewith, which Tease covered (with other property) the foiiowing-described real property situate in Hall County, Nebraska, to-wit: The West 1L 8.5 feet of Lot Fourteen (i4) of Vantine Subdivision, located an Bart of the Northwest Quarter (NW/4) of Section 22, Township 11 North, Range 9 West of the 6th P.M., and is recorded in Book 16 at page 375 of the records of said county; and WHEREAS, it is the mutual desire of the parties that the lessor's interest in and to the aforesaid Lease may be reassigned to the Company. NOW, THEREFORE, for and in consideration of One Dollar and other good and valuable considerations, the receipt and sufficiency whereof are hereby acknowledged, the Trustees do hereby and by these presents assign, sell, transfer and set over unto Company all of the Trustees' interest in the above- described Lease, insofar as said lease covers the above-described real property. TO HAVE AND TO HOLD said Lease unto the Company, its successors and assigns, forever. IN WITNESS WHEREOF, the Trustees have execu*_ed this instrument as oL the day of 11~ L' 1979.
