79-» #: iii ~ ~1 <br />*_he plat of such subdivision when finally approved by the ~Zegional <br />P3.anning Commission and the City Council to be acknowledged by such <br />owners, certified as to accuracy of survey by a registered land surveyor, <br />and to contain a dedication of the easements to public utilities. In <br />consideration of the acceptance of the plat of Regency By The Green <br />Znd Subdivision, the Subdividers hereby consent and agree with the City <br />,of Grand Island, Nebraska, that they will install or provide at their <br />expense the following improvements: <br />1. Water, Sanitary Sewer, and Paving. The Subdividers agree to <br />provide the services of water, sanitary sewer, and paving in accordance <br />with the Subdivision Agreement for the Regency By The Green Subdivision. <br />2. Drainage. In accordance with the Subdivision Agreement of <br />Regency By The Green, the Subdividers agree to provide storm sewer <br />drainage for said subdivision by grading the lots within this subdivision <br />i.n conjunction with the structures thereon so that the storm water <br />drainage drains in accordance with plans approved by the City's Director <br />of Public Works. The storm sewer drainage system shall be constructed <br />in accordance with said plans prior to the issuance of any and all <br />building permits within said subdivision. The Subdividers further agree <br />that the structures located on Lots 1 and 2 of this subdivision shall <br />be placed no closer than 20Q feet from the thread of stream of the <br />Wood Fiver. <br />3. Sidewalks. The Subdividers, if still the owners of the land in <br />the proposed subdivisior_, or if the Subdividers shall have transferred <br />title to the property, then the various grantees thereof, will install, <br />at their own expense; ail public sidewalks required by the Grand Island <br />City Code when the adjacent lot is built upon, and sidewalks shall be <br />regulated and required with the building permit for each such lot. <br />4. Warranty. The undersigned owners, as Subdividers, warrant that <br />they are the owners in fee simple of the land described and proposed to <br />be known as Regency By The Green 2nd Subdivision, and that an abstract <br />of title will be subaitted for examination, if necessary, upon request <br />of the City of Grand Island. <br />-z- <br />
