<br />E A S E M E N T
<br />JANICE THAYER and PA^1RICIA E. WiSSEL, herein called the Grantors,
<br />in consideration of ~~ ~~{,~~ r~..'Q
<br />receipt of which is hereby acknowledged, hereby grant and convey unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Hall County, Nebraska, herein called the
<br />• Grantee, a permanent and perpetual easement and right-of-way to survey,
<br />construct, inspect, repair, replace, remove and operate thereon, under-
<br />ground electrical distribution lines, and other appurtenances connected
<br />with such utility, upon, above, across, underneath and through a tract
<br />of land cumprising a part of Golden Age Second Subdivision in the City
<br />of Grand island, Nebraska, more particularly described as follows:
<br />The southerly four (4) feet of the westerly one hundred
<br />seventy (170) feet of Lit One (1) of said Golden Age
<br />Second Subdivision, said tract of land containing 0.02
<br />acre, more or less, as shown on the plat dated 5/17/79,
<br />marked Exhibit "A" attached hereto and incorparated herein
<br />by reference;
<br />together with ail rights of unrestricted ingress and egress for installation
<br />and maintenance of such utilities and appurtenances.
<br />Such rights of ingress and egress shall include all rights necessary
<br />for the full and complete use, occupation and en}oyment of the easement
<br />herein granted, including the right to excavate and refill ditches and
<br />trenches, to remove trees, bushes, hedges, undergrowth, and other obstruct-
<br />ions interferring with the location, construction, inspection, repair,
<br />replacement, removal and maintenance of s•~ch utilities. No improvements,
<br />structures, or buildings of any kind whatsoever shall be allowed in,
<br />upon, or over the easement herein granted.
<br />Any such appurtenances placed by the Grantee upon, above, across,
<br />underneath or through the tract of land above described shall remain r_he
<br />property of the Grantee.
<br />The Grantors, for themselves, their heirs, devisees, executors,
<br />administrators, successors and assigns, hereby covenant that the rights
<br />and privileges herein granted shall run with the title to such tract of
<br />land and shall be binding upon the above mentioned parties.
