<br />The Grantor, the County of Hall, Nebraska, a political subdivision
<br />under the laws of the State of Nebraska, in consideration of ONE HUNDRED FDnTV=
<br />FIVE THOUSAND AND NO/100 DOLLARS {$146,00^u.00) received from Grantee, does
<br />quitclaim, grant, bargain, sell, convey, and confirm unto the City of Grand
<br />Island, Nebraska, herein called the Grantee, the following described real property
<br />in HaIT County, Nebraska:
<br />A tract of land comprising the West Half of the Northeast Quarter of
<br />the Southeast Quarter {W~NE45E;), and the East Half of the Northwest
<br />Quarter of the Southeast Quarter (E~NW4SE4), all in Section Thirty-Four
<br />(34), Township Twelve (TZ} North, Range Nine (9) West of the 6th P.M.
<br />in Hall County, Nebraska, more particularly described as follows:
<br />Beginnfing at tfie Northeast corner of said W~NE;SE4; thence southerly
<br />along the East Tine of said W~tlE4SE~„ a distance of One Thousand
<br />Three Hundred Fourteen and Seventy-Eight Hundredths (1,314.78} feet,
<br />to the Southeast corner of said W~ildE~SE4; thence westerly along the
<br />South Tine of said W~NE~,SE; and the South Tine of said E~liW4SE;, a
<br />distance of One Thousand Three Hundred Twenty-One and Sixty-Three
<br />Hundredths (t ,321.63) feet, to the Southwest corner of said E~WW~,SE~t:
<br />thence northerly along-the West line of said E~VW3;SE;, a distance of
<br />One Thousand Three Hundred Th'.rteen and Nine Tenths (7,313.9) feet,
<br />to the Northwest corner of said E~IW~-,SEA; thence easterly along the
<br />North line of said E~IW~SE~. and the North Tine of said W~NE~,SE~;, a
<br />distance of One Thousand Three Hundred Twenty-One and Eight Tenths
<br />(T ,321.8) feet to the place of beginning and containing 39.617 acres
<br />more or Tess,
<br />for the construction of the Nebraska Law Enforcement Training Canter thereon.
<br />SUBJECT TO THE RESERVATIONS, CONDITIONS, RESTRICTIONS, AND PROVISIONS AS
<br />FOLLOWS:
<br />T. In the event that the Grantee, its successors and assigns,
<br />fails to commence within three years of this date and with
<br />diligence thereafter to pursue and actively use the Law
<br />Enforcement Training Center upon the above-described premises
<br />and land used in connection therewith for such purposes, or
<br />for other kinds of compatible uses by a State agency or entity
<br />of the State, title and right of possession, in either event, to
<br />said land and all improver,~ents thereon, shall revert to and
<br />revert in Grantor, County of Hall, Nebraska, its successors
<br />and assigns, upon demand therefor made in writing at least 60
<br />days prior to date fixed for reverting of such title, right
<br />of possession and other rights transferred or any portion thereof.
<br />2. The Grantor, County of Hall, Nebraska, reserves unto itself,
<br />its successors and assigns, for the use and benefit of the
<br />public a right of flight for the passage of aircraft in the
<br />airspace above tt-e surface of the real property herein described,
<br />together x'ith the right to cause in said airspace such noise as
<br />may be inherent in the operation of aircraft, now known or hereafter
<br />used, far navigation of or flight in the said airspace, and for
<br />use of said airspace for landing on, taking off from, er operating
<br />an the Nall County Regional Airport.
