<br />BRENTkT00D DEVELOPMENT CO. of Grand Island, a Nebraska
<br />corporation, hereinJcalled the Grantor, in consideration of
<br />pn~r (~otl~lt receipt of which is hereby acknowl-
<br />edged, hereby grants and conveys unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />.a municipal corporation in Hall County, Nebraska, as Grantee, a permanent
<br />and perpetual easement to construct, operate, r=iaintain, repair, replace,
<br />and remove underground electric utility lines, poles, surface markers,
<br />and any other appurtenances or fixtures connected therewith, and North-
<br />western Bell Telephone Company telephone cables, in, upon, over, within,
<br />underneath and through tracts of land located in part of Blocks Two (2)
<br />and Three (3) of Brentwood Second Subdivision in the City of Grarid Island,
<br />Nebraska, more particularly described as follows:
<br />The southerly five (5) feet of Lot Seven (7), the
<br />northerly five (5) feet of Lot Eight (8), the southerly
<br />eight (8) feet of Lot Eleven (11}, and the northerly
<br />eight (8) feet of Lot Twelve (12), aiI in said Block Two
<br />(2) of Brentwood Second Subdivision; and
<br />The easterly eight (8) feet of Lots 1, 2, 3, 4, 5, 5,
<br />7, 8, 4, 10, 11, 12, and 13; and the southerly eight (8)
<br />feet of Lot 1.0; and the northerly eight (8} feet of Lot
<br />11; all in said Block Three (3) of Brentwood Second Sub-
<br />division,. said tracts of land containing 0.34 acre, more
<br />or less, as shown on the plat dated 4/Zbi74, marked Exhibit
<br />"A" and attached hereto and incorporated hereir. by reference;
<br />together with the following rights: Unrestricted ingress and egress
<br />through, above, across, and underneath the above described tracts of
<br />land for the purpose of exercising the rights herein granted and the
<br />right to clear and keep Clear of trees, roots, brush, shrubbery and
<br />other obstructions from the surface of such tracts of land.
<br />All utility Iines, poles, surface markers, cables, terminals
<br />and other appurtenances placed upon, over, within, underneath and through
<br />such easements shall remain the property of the Grantee and may be
<br />removed or replaced at any time.
<br />The Grantor, for itself, its successors aad assigns hereby
<br />~wenants that no structures or other obstructions shall be erected or
<br />permitted on such tracts of land.
