<br />JOHNSON LAND COMPANY, a Nebraska corporation, herein called
<br />the Grantor, in consideration of Q~~ ~c}~y,~.~~
<br />receipt of which is hereby acknowl-
<br />edged, hereby grants and conveys unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Ha11 County, Nebraska, herein called the
<br />`Grantee, a permanent and perpetual easement and right-of-way to survey,
<br />construct, inspect, repair, replace, remove and operate thereon, under-
<br />ground electrical distribution lines, and other appurtenances connected
<br />with such utility, upon, above, across, underneath and through two tracts
<br />of land located in part of Block One (1) of Colonial Estates Subdivision
<br />in the City of Grand Island, Nebraska, more particularly described as
<br />follows:
<br />The northerly five (5} feet of Lat Seven (7}, and the
<br />southerly five (5) feet of Lot Eight (8), all in the
<br />said Block One {i), Colonial Estates Subdivision, said
<br />tracts of la^.d nt3iring ~J.C3 acr mare or less, as
<br />shoc.~ on the plat dated 4/27179 marked Exhibit "A",
<br />attached hereto and incorporated herein by reference;
<br />together with the following rights: Unrestricted ingress and egress
<br />tt;rough, above, across, and underneath the above described tracts of land
<br />for the purpose of exercising the rights herein granted and the right to
<br />clear and keep clear of trees, roots, brush, shrubbery, and other ab-
<br />structions from the surface of such tracts of land.
<br />All electrical utility lines, poles, surface markers, cables,
<br />terminals and other appurtenances placed upon, a•.er, within, underneath,
<br />and through such easements shall remain the prawert;~ of *he Grantee and
<br />away be reproved ar replaced at any time.
<br />T!:e Granter, far itself, its successors and assigns, hereby
<br />ctrven.ants that no structures or other obstructions shall he erected or
<br />permitted an such tracts of land.
<br />The Grantor, foz itself, its successors and assigns, hereby
<br />covenants that the rights and privileges herein granted shall run with
<br />he title to such tracts of land and be binding ugon the above-mentioned
<br />parties.
