Briggs, being first duly sworn upon oath, deposes <br />and says: <br />1. He is a resident of Hall County, Nebraska, and that he <br />is President of Continental Gardens Homeowners Association, a <br />non-profit Nebraska corporation, organized to provide for the <br />maintenance, preservation and architectural control of the residen- <br />tial lots and Comumon Area within that certain tract of property <br />described as Block One (il and Block Two (2) of Continental Gardens, <br />ar. Addition to the ~'ity of Grand Island, ..all County, Nebraska, <br />and such other real <~state as may be hereafter annexed thereto by <br />Mid-C ontit;ent Enterprises, Inc. <br />2. Pursuant to the By-Laws and Declarations of said Home- <br />owners Association, the Association has established an assessment <br />against its members in the amount of Four Hundred Forty-Une and <br />noj100 Dollars (541.04) per }.°sar in inczements of Thirty-Six and <br />75/100 Dollars (536.75) per month so as to enable the Association <br />to carry out its purposes as statea hereinabove. <br />3. Deborah L. Vanosdall, by virtue of being the owner of the <br />real estate described as Lot Thir}een (13) in Amended Block Six (6) <br />in Continental Gardens, an Addition to the City of Grand Island, <br />Halt County, Nebraska, is a member of said Continental Gardens <br />Hameowners .Association and therefore subject to the terms and con- <br />ditions of the By-Laws and Declarations of said Homeowners Association. <br />4. Said lleborah L. Vanosdall has failed to gay to the Continen- <br />tal Gardens Homeowners Association the assessment against Lot Thirteen <br />(13) in Amended Block Six {61 of Continental Gardens far a period of <br />time from January 1, 1379 through May 1, 1979, for a total amount <br />owing to said Hame~wners Association in the amount of One Hundred <br />Seventy-Eight and 50/100 Dollars {$178.50) plus nine percent {9%) <br />per annum as authorized by the Association's By-Laws.
