Briggs, being first duly sworn upon oath, deposes and says: 1. He is a resident of Hall County, Nebraska, and that he is President of Continental Gardens Homeowners Association, a non-profit Nebraska corporation, organized to provide for the maintenance, preservation and architectural control of the residen- tial lots and Comumon Area within that certain tract of property described as Block One (il and Block Two (2) of Continental Gardens, ar. Addition to the ~'ity of Grand Island, ..all County, Nebraska, and such other real <~state as may be hereafter annexed thereto by Mid-C ontit;ent Enterprises, Inc. 2. Pursuant to the By-Laws and Declarations of said Home- owners Association, the Association has established an assessment against its members in the amount of Four Hundred Forty-Une and noj100 Dollars (541.04) per }.°sar in inczements of Thirty-Six and 75/100 Dollars (536.75) per month so as to enable the Association to carry out its purposes as statea hereinabove. 3. Deborah L. Vanosdall, by virtue of being the owner of the real estate described as Lot Thir}een (13) in Amended Block Six (6) in Continental Gardens, an Addition to the City of Grand Island, Halt County, Nebraska, is a member of said Continental Gardens Hameowners .Association and therefore subject to the terms and con- ditions of the By-Laws and Declarations of said Homeowners Association. 4. Said lleborah L. Vanosdall has failed to gay to the Continen- tal Gardens Homeowners Association the assessment against Lot Thirteen (13) in Amended Block Six {61 of Continental Gardens far a period of time from January 1, 1379 through May 1, 1979, for a total amount owing to said Hame~wners Association in the amount of One Hundred Seventy-Eight and 50/100 Dollars {$178.50) plus nine percent {9%) per annum as authorized by the Association's By-Laws. Affiant states that as President of the Continental Gardens Homeowners Association he hereby claims a lien on the real estate rescribed hereinabove as authorized by the Association's By-Laws and Declara*_ions for the fu 11 amount of the unpaid account, to-wit: the sum of One Hundred Seventy- Eight and 50/100 Dollars {5178.5fl) plus interest thereon at the rate of nine percent (9%) from the first day of January, 1979, and together with such additional monthl de'i •- ~ .. ir. the amount of Thirty-Six and 75,/140 Dollars (536.75) per~month+as may continue to accrue.
