<br />WHEREAS, GERALD D. FREDERIKSEN and L. JUNE P&FDFRZKSE±4, h~xaband and wife,
<br />are the owners of all lots in Shady Lane Subdivision, a Subdivision located in
<br />the South Half of the Southeast Quarter (S~$E~) ofscction Fvurica, (l,), ':-~ -
<br />ship Eleven (11) North, Range Nfne (9), West of the 6th P.*1., in Hall County,
<br />Nebraska, as 'are specifically described in the plat of said 8ubdivialon, and
<br />WHEREAS, it is the desire of the aforesaid owners of said Snbdivisioa to
<br />ispzove Shady Lane Subdivision by encouraging the sale of lots Ana construction
<br />of modern and deairalile dwelling houses; and
<br />WHEREAS, the aforesaid owners did execute a certain Agreemeat for Protective
<br />Covenants, Restrictions and Coaditiona for Shady Lane Subdivision located in Ha21
<br />County, Nebraska, dated June 1, 1977, which said Agreement was filed on 3vne 8,
<br />1977, and recorded as Document Numbez 77-003162 in the office of the Hall County
<br />Regfster of Deeds; and
<br />WHEREAS, the aforesaid owners desire to clarify a ceztain portion of the
<br />above-mentioned Agzeement;
<br />NOW THEREFORE, the aforesaid owners do hereby stipulate and agree that
<br />paragraph ssamber 8 in acid P.§reea~t shall read: The only feaciag material which
<br />may be used upon Lots 6,5,6 and 7 are those which are manufactured and designed
<br />for residential use, which shall exclude barbed wire, hog fence, and all other
<br />fencing not in common residential use.
