No commercial business of any kind, including <br />beauty shop and insurance business, will be permitted to be <br />operated out of, upon or €rom any of the Lots 1 through 65 <br />in the subdivision. It is mandatory that construction of the residence <br />commence within 15 months from the date of the original sale <br />of the lot. This regulation will apply to both original <br />purchasers from the subdivider and also to any other purchasers <br />obtaining title from the original ;urchaser. Each residence <br />including attached garage, shall be completed within eight <br />months from the date of the start of the construction. No television reception equipment shall be constructed <br />or erected outdoors whether attached to a building or not. <br />Radio equipment may be placed outside, attached to the <br />residence, but separate radio towers are subject to approval <br />by the subdivider, which may be denied. <br />15. All construction and building shall be so performed <br />that it will comply with the requirements of the applicable <br />city, county and state building codes and ordinances. <br />Under-ground electric and telephone service systems are <br />required. <br />16. Every drive from the street to the attached two <br />car garage shall be constructed of concrete. No front yard <br />fences shall be allowed. Back yard fences must be of wood, <br />-chain link, stone or masonary construction. No barbed wire, <br />woven wire or creosoted treated posts or any unsightly <br />material shall be used in any fence. <br />17. These covenants and restrictions are to run with <br />the land and shall be binding upon all parties and all <br />persons claiming under them and all subsequent purchasers <br />for a period of ten years from the date hereof, at which <br />time the covenants shall be automatically extended for <br />successive periods of ten years each unless, by vote of the <br />majority of the then owners of lots in the subdivision, it <br />i.s agreed to change the covenants in whole or in part. <br />18. If any owner of any lot in the subdivision or <br />their heirs or assigns, shall violate or attempt to violate <br />any of these covenants it shall be lawful for any other <br />Berson owning any real property situated in the subdivision <br />to prosecute any civil proceedings at law or equity against <br />the person or gersons violating or attempting to violate the <br />covenants and either prevent him or them from so doing or to <br />recover damages for such violation. <br />19. Invalidation of any one of these covenants by <br />court order shall in no way affect any of the other provisions <br />and covenants herein contained. <br />20. This agreement shall be binding upon the heirs, <br />personal representatives, assigns and grantees of any of <br />Lots 1 through 65 in the Castle Estates Subdivision, and <br />upon any person or entity claiming any right, title or <br />interest in or to any portion of any of those lots. <br />-3- <br />
