~9- u~.~.19~J~ 3. Sanitary Sewer. Sanitary sewer service is available along the north edge of said subdivision, Lot One (1) has access to sanitary sewer service to a main located in Webb Road. Should Lot One (1) connect to sanitary sewer service along the north edge of said sub- division, the Subdivider agrees to grant a necessary sewer service easement across Lot Two (2) for the use of Lot One (1). The Subdivider further agrees to connect all structures within said subdivision to city sanitary sewer service prior to the issuance of any occupancy permits within said subdivision. 4. Drainage. The Subdividers agree to grade all lots within said subdivision in conjunction with the structures thereon so that the storm water drains to public right-of-way. 5. Sidewalks. The Subdivider, if still the owner of the land in the proposed subdivision, or if the Subdivider shall have transferred title to the property, then the various grantees thereof will install, at their own expense, all public sidewalks required by the Grand Island City Code when the adjacent lot is built upon, and sidewalks shall be regulated and required with the building permit for each such lot. 6. Warranty. The undersigned owner, as Subdivider, warrants that it is the owner in fee simple of the land described and proposed to be known as Mary Moppet Subdivision, and that an abs*_ract of title will be submitted for examination, if necessary, upor_ request of the City of Grand Island. 7. This agreement shall run with the land and s'_:all be binding upon and inure to the benefit of the parties hereto, their successors, assigns, heirs, devisees, and legatees, Where the term "Subdivider" is used in this agreement, the subsequent owners of any lots in the Subdivision shall be responsible to perform any of the conditions of this agreement if the Subdivider has not performed such conditions.
