79-- €~ ~ 1'7 5 ~ <br />LICENSE AGREEMENT <br />THIS AGREEMENT by and between the City of Grand Island, a <br />municipal corporation in Hall County, Nebraska, hereinafter referred <br />to as the City, and A. E. Van Wie, hereinafter referred to as the <br />Licensee, wade and entered into this ~_ day of D~'Gf~7'r~eti°. 1978 <br />_ WITNESSETH: <br />HF.EREAS, the Licensee desires to pave public right-of-way <br />located in the alley south of Faidley Avenue between P.uby and Carey <br />Streets, said alley lying adjacent to a pxoposed twelve-unit apar~ent <br />complex at 2243 West Faidley Street. <br />u~~ 7'KF7tFF{]RF, IN C4~ISII~ERATION of the mutual covenants herein- <br />after stated, the parties agree as follows: <br />i. The City hereby grants to the Licensee a license to pave <br />the above described street right-of-way in accordance with plans and <br />specifications approved by the ITepartment of Public Works to incorporate <br />therein the boxing off -in individual square framework of the areas <br />surrounding utility poles located within public right-of-way. <br />2. It is understood and agreed that tha Li;er_see car_ construct <br />and maintain such improvements in the public right-of-way at his own <br />risk, The Licensee hereby waives any claia for damages against the <br />City of Grand Island, its officers, agents, and eaployees, and independent <br />txntractors for any damage or injury that map result to said improvement <br />being located in the City street right-of-way. <br />3. The Licensee shall indemnify and hold harmless the City frot- <br />and against any and all loss and damage and any and all claims, demands, <br />_ suits, liabilities, and payments in contract or tort, penal ox othex- <br />wise, resulting from or in respect of the Licensee's use of the City <br />scree;. right-of-way for the aforementioned paving. <br />4. This license sha12 take effect immediatelg upon the date of <br />the last party eaecnting this agreement, and shah continue for an <br />indefinite tom; Provided, that either pang may terminate this agree- <br />-": amt at ~y time by giving the other party thirty days written notice. <br />_. . <br />:, . <br />
