<br />EASEMENT
<br />Richard H. Franzen and June A. Franzen, husband and wife, each
<br />in his and her own right and as spouse of the other, herein called
<br />the Grantors , in consideration of 0,t/~ l~DLtg2 ~ ~ / ~~
<br />receipt of which is hereby acknowledged, hereby ¢rant and convey unto
<br />the
<br />CITY OF GRAND ?SI.AND, NEBRASKA,
<br />a muTicipal corporation; ir. Hall County, A?ebraska, as Grantee, a permanent
<br />and perpetual easement to construct, operate, r.~aintain, repair, replace,
<br />and remove underground and overhead electrical utility distribution lines,
<br />poles, surface markers and any other appurtenances or fixtures connected
<br />therewith, and Northwestzrn Bell 't'elephone Company telephone cables and
<br />appurtenances thereto, in, upon, over, within, underneath and through a
<br />tract of Iand located ir. part of the Northwest Quarter of the Southwest
<br />Quarter (Nk*~SW~) of Section Four (4), Township Eleven (11) North, Range
<br />Nine (9) West of the 6th P.M., Hall County, Nebraska, more particularly
<br />descrit~ed as follows
<br />Begir_ning at a point on the easterly right-of-way line of
<br />Highway 281, said point being forty (40) feet East and
<br />one hundred fifty and eight-tenths (15J.8) feet South
<br />of the Northwest cor*_:er of the Sout`_:west Quarter of said
<br />Section. Four (w); thence running easterly along a line
<br />parallel to the North line of Rains Subdivision for a
<br />distance of one hundred fifty (i5C) feet; t^ence running
<br />northerly far a distance of eight (8) feet; whence running
<br />westerly along a line parallel with the r_ortherly line of
<br />Pains Subdivision for a distance of one hundred fifty (150)
<br />feet to a point on the easterly right-of-way line of Highway
<br />281; thence southerly along said right-af-way line for a
<br />distance of eight (8) feet to the point of beginning, said
<br />tract of land containing 0.03 acres, more or less, as shown
<br />on the plat dated 3/14J79, marked Exhibit "A", attached
<br />hereto and incorporated herein by reference,
<br />together with the following rights: unrestricted ingress and egress
<br />through, above, across and undernea*_h the above described tract of land
<br />for the purpose of exercising the rights herein granted and the right
<br />to clear and ?seep clear of trees, roots, brash, shrubbery and other
<br />obstructions fror; the surface of such tract of land.
<br />All electrical utility lines and telephone lines, poles, surface
<br />mariners, cables, terminals and other appurtenances placed upon, over,
<br />within. undereath acid through such easement shall remain the property
<br />of the Grantee and n.~y be removed or replaced at any time.
