<br />Subdivider hereby cansents and agrees zrith the City of Grand island, <br />Nebraska, that it will install or provide at its expense t~"ie following <br />improvements: <br />I. Pavia ,. 'T'he Sub<°=.vider waives the right to object to any <br />paving or repaving district for Fifth Street where it abuts said sub- <br />division. <br />2. Water. City water main service is available to the subdivision <br />within the public right-of-slay known as Faidley Avenue. The Subdivider <br />agrees to connect ail structures within said subdivision to city water <br />service prior to the issuance of any occupancy permits. Sanitary sewer service is available to all <br />Lots within said subdivision through mains located in Fifth Street and <br />the westerly edge of West Heights Second Subdivision. The Subdivider <br />agrees to connect all structures within said subdivisior_ to said sani- <br />tary sewer service prior to issuance of any occupancy permits and sub- <br />ject to any and 311 connection fees for said service. <br />4, Drainage. The Subdivider agrees to grade ail the to*_s ir. <br />conjunction with the structures thereon in such a manner as to conduct <br />storm water flow to the city scorn sewer Hain Iocated ir. Fai.dley P,verue. <br />5. Sidewalks. The Subdivider, if still. the owner of the land in <br />the proposed subdivision, or if the Subdivider shall have transferred <br />title to the property, then the various grantees thereof, will ins*_all, <br />at their own expense, all public sidewalks required by the Grand Island <br />City Code when the adjacent lot is built upar:, and sidewalks shall be <br />regulated and required with the building perriit for each such lot. <br />5. Warranty. The undersigned owner, as 5u.bdivider, warrants that <br />it is the owner in fee simple of the land described and proposed to be <br />known as Dau Subdivision, and teat an abstract of title will be submitted <br />for examination, if necessary, upon request of the City of Grand Island. <br />7. This agreement shall run with the land and shall be binding, <br />upon and inure to the benefit of the parties hereto, their successors. <br />assigns, heirs, devisees, and legatees. <br />- 2 - <br />
