Briggs, being first duly sworn upon oath, deposes <br />and says: <br />1. He is a resident of Hail County, Nebraska, and that he <br />is President of Continental Gardens Homeowners Association, a <br />non-profit Nebraska corporation, organized to provide far the <br />maintenance, preservation and architectural control of the resi- <br />dential lots and Common Area within that certain tract of prop- <br />erty described as Block One {1) and glo~k Two i2} of Continental <br />Gardens, an Addition to the City of Grand Island, Hall County, <br />Nebraska, and such other real estate as may be hereafter annexed <br />thereto by Mid-Continent Enterprises, Inc. <br />2. Pursuant to the By-Laws and Declarations of said Home- <br />owners Association, the Association has established an assessment <br />against its members in the amount of Three Hundred Twenty-foux <br />and No/100 Dollars ($324.00) per year in incsement~ of Twenty- <br />seven and N~!100 Dollars ($27.00) per month sa as to enable the <br />Association to carry out its purpases as stated hereinabove. <br />3. John E. Slattery and Nancy A. Slattery; by virtue of <br />being owners of the real estate described as Lot Six (6} in Block <br />One (1} in Continental Gardens, an Addition to the City of Grand <br />island, Hall County, Nebraska, are members of said Continental <br />Gardens Homeowners Association and therefore subject to the terms <br />and conditions of the By-Laws and Declarations of said Homeowners <br />Association. <br />4. Said John E. Slattery and Nancy A. Slattery have failed <br />to pay to the Continental Gardens Homeowners Association the <br />assessment against Lot Six (b) in Block One (1) of Continental <br />Gardens for a period of tiros from February i, 1978 to March 1, <br />1979, for a total amount owing to said Homeowners Association in <br />the amount of Three Hundred Fifty-one and Nol100 Dollars ($351.00) <br />plus nine per cent (98) per annum as authorized by the Associa- <br />tion's By-Laws.
