The City of Grand Island, Nebraska, by action of its city council <br />on June 12, 1978, enacted Ordinance No. 6307 which. directed the conveyance <br />of the real estate described below and the manner and terms thereof. <br />2, Ordinance No. 6307 was published in the Grand Island Daily <br />Independent, a legal newspaper published in and of general circulation <br />in such City on June 19, 1978, and immediately thereafter, notice of such <br />sale and the terms thereof were publiihed in the Grand Island Daily <br />independent for three consecutive weeks, on Jure 14, June 26, and July 3, <br />197$, all as required by Section 16-202, R.R.S. 1943. <br />3. No remonstrance against such sale was filed with the city council <br />of the City of Grand Island, Nebraska, within thirty days of the passage <br />and publication of such Ordinance No. 6307. <br />4. Section 5 of Ordinance No. 6307 provides that if no remonstrance <br />be filed against such conveyance, the mayor and city clerk-finance director <br />shall make, execute, and deliver to the Grantees a quitclaim deed for said <br />real estate, and the execution of such quitclaim deed is hereby authorized <br />without further action on behalf of the city council.. <br />NOW, THEREFORE, the City of Grand Island, Nebraska, a municipal <br />corporation in Hall County, Nebraska, as Grantor, in consideration of One <br />Dollar ($1,00); does hereby quitclaim, grant, bargain, sell, convey, and <br />confirm unto <br />BERitIA R. DAU, BERIvtiARD W. DAii, and BLANCH I. DAU, <br />as equal tenants in common, herein called the Grantees, the following <br />described real property in Hall County, Nebraska: <br />A tract of land i_~ the SauthFrest Quarter (SW~) of Section <br />Seventeen {17), Township Eleven (il} North. Icange Nine (9; <br />West of the 5th P.M., being in the City of Grand Island, <br />Nebraska, and more particularly described as follows: <br />A tract of land sixty {60) feet in width, being thirty (30) <br />feet on either side of the line between the Northwest Quarter <br />(NW 4) and the Northeast Quarter of the Southwest Quarter <br />(NE~-SW4) of said Section Seventeen (17), from the south line <br />of Faidley Avenue south for a distance of six hundred ten <br />(610) feet, or 185,928 meters, more or Less, to the north line <br />of 5th Street, subject to two easements in the north sixty (60) <br />feet, or 18.28$ meters, of said tract lying adjacent to and <br />joining the south Line of Faidley Avenue, said easements <br />recorded in Miscellaneous Boak 12 at gage 651 and recorded <br />in Miscelleaneous Book I6 at page 99, both books in the office <br />of the Register of Dezds, Ha 11 County, Nebraska; the above <br />described tract of land except the two easements conveyed to <br />the City of Grand Island, Nebraska, contains a total of <br />34,680 square feet, or 321.434 square meters, all shown on <br />the plat marked Exhibit "A" attached hereto and incorporated <br />herein by reference. <br />To have and to hold the above described premises, together with all <br />tenements, hereditaments and appurtenances thereto belonging unto the <br />Grantees and to Grantees` heirs and assigns forever. <br />Dated _F~O <br />I N~SRAS#~ ~~ ~;~_.~ =R; ~-h nu ~ <br />,~ .. <br />~;~ : ~~ <br />~: ~. <br />,.~ ; ~ ~, <br />- ~~ : .
