<br />REFEREE'S DEED
<br />KNOW ALi. MEN BY THESE PRESENTS:
<br />That whereas, in an action ~f partition pending in the District
<br />Court of Hall County, Nebraska, wherein Carl H. Neemann, et al.,
<br />are Plaintiffs and Harland Rounds, et al., are Defendants, for the
<br />partition of the premises hereinafter described, the undersigned
<br />Referee, dt:ly appointed by said Court to make partition of said real
<br />estate, made report in writing, duly signed, setting forth that
<br />partitio~i of said real estate could not be made without great prejudice
<br />to the owners thereof, which report was duly examined by the Court,
<br />and said Court, being satisfied therewith, confirmed the same, axxi
<br />thereupon made an order directing the undersigned Referee to sell said
<br />premises on the following terms, to-wit: 20X cash and the balance
<br />upon confirmation.
<br />In pursuance of said order, the undersigned Referee, after giving
<br />bond and taking the oath required by law, caused a notice to be
<br />published in the Grand Island Daily Independent, a newspaper priated
<br />and in general circulation in Hall County, Nebraska, that said lefaree
<br />would offer said real estate for sale in the main corridor-am the grouted
<br />floor of the Courthouse in the City of Grand Island, Hall County, Nebraaks,
<br />an the 15th day of December, 1978, at 2:00 P.M. on said day, anti at
<br />the time and place stated in said notice, and after said notice had
<br />been published for more than thirty days, such real estate, to-vit:
<br />The Northeast Quarter of the Northeast Quarter
<br />(NF~TE'~) of Section Twenty-Eight (28), Township
<br />Twelve (12) Nozth, Range Eleven (11) West of the
<br />6th P.M., in Hall County, Nebraska,
<br />was offered for sale at public auction and sold to Ervin M. Hostetler
<br />atsti Karen R. Hostetler, husband and wife, as joint tenants, for the
<br />sum of Sixty Six Thousand Dollars 056,000.00), they being the highest
<br />bidders therefor, and afterwards on the 3rd day of January, 1979, I
<br />reported said sale to the Court, and on the 15th day of 3anuary, 1979,
<br />said Court approved and confirmed said sale and ordered and directed
<br />the undersigned lt4feree to execute and deliver to Ervin M. Hostetler
<br />and Karen K. Hostetler, husband and wife, a deed comreying said real
<br />estate to them as joint tenants and not as tenants in coieaon;
<br />NOW THEREFORE, I, Earl D. Ahlschwede, Referee, in consideration of
<br />the sum of Sixty Six Thousand Dollars (~b(s,000.00) so bid and paid, and
<br />by virtue of the powers vested in me by law, do sell, vest and grant
<br />unto Ervin M. Hostetler and Karen K. Hostetler, husband and wife, as
<br />joint tenants and not as tenants in common, the following described Taal
<br />estate, to-wit:
<br />The Northeast Quarter of the Northeast Quarter
<br />{NE%NF~) of Section Twenty-Eight {28), Township
<br />Twelve (12) Nor`h, lunge Eleven (11) 51est of the
<br />6th P.M., in Hall County, Nebraska,
<br />together with all the appurtenances thereunto belonging.
<br />It being the intention of +s11 parties hereto, that in the event
<br />of flee death _f eithrr of said grantees, the entire fee side title
