<br />WHEREAS, Jae C. TePoel, a single person, was the owner of the follow-
<br />ing described real property which he had contracted to sell:
<br />~ot Fourteen {14), in-Block Five {5}, in Ashton Place,
<br />an Addition to the City of Grand Island, Hali County,
<br />Nebraska, and
<br />WHEREAS, prior to completion of said sale, the said Joe C. TePoel
<br />became incapacitated and executed a Power t~f Attorney authorizing and di^ecting
<br />8. J. Gunningham, Jr. and William A. Francis to complete said sale and convey
<br />said property as attorneys for said Grantor, and
<br />WHEREAS, the Power of Attorney and the Warranty Deed conveying said
<br />property both contained an erroneous description in which said property was des-
<br />cribed as being in Black Four (4},rather than in Block Eive {5}, being the
<br />correct block number, and
<br />WHEREAS, said Power of Attorneyy and Warranty Deed, being Document
<br />No. ?8-0068960, have been recorded in Ha11 Gaunty, Nebraska, containing said
<br />erroneous description, and whereas, B. J. Gunningham, Jr. is the duly appointed -
<br />Persanai Representative of the Estate of Joe C. TeP~el by the terms of the dece-
<br />dent's East Wili and Testament heretofore admitted to probate in the Hall County -
<br />Court, and
<br />WHEREAS, Clara Kisseli is the sole residuary beneficiary of the
<br />Estate of Joe C. TePoel, deceased,
<br />NOW, THEREFORE, in consideration of the sum of One Do}lar {1.00)
<br />and ether valuable consideration, the undersigned B. J. Cunningham, Jr., Per-
<br />sonal Representative of the Estate of Joe C. TePoel, deceased, and Clara Kissel,
<br />a single person, being the sole residuary beneficiary under the last Will and
<br />Testament of tht Said Joe C. TePoel, do hereby transfer and convey to Mildred f.. -_
<br />Hugeard, the following described real property:
<br />Lot Fourteen (14}, Block Five {5) in Ashton Place, an
<br />Addition to the City of Grand Island, Hall Gounty,
<br />Nebraska,
<br />To have and to hold the described premises with all improuements
<br />thereon and belonging to the said Jae C. TePoel, deceased, and to his heirs, and
<br />the Grantora hereby covenant that said premises are free and clear from liens
<br />or encumbrances; that Grantors warrant and will defend the title to said real
<br />estate against the lawful claims of all persons claiming the same or any part thereof. --
<br />This Deed is given to correct an erroneous description in a Warranty
<br />Deed dated September 22, 1978, and recordeductober 20, 1978, as Document Na.
<br />?8-006896.
