<br />DEED OF TRUST
<br />THIS DEED OF TRUST is made this 30th day of December, 2009, by and between
<br />PATRICIA J. HANCOCK and ROBERT D. HANCOCK, wife and husband, whose mailing
<br />address is 5938 N. 80 Rd., Cairo, NE 68824 and PEGGY J. RADFORD and JOSEPH M.
<br />RADFORD, wife and husband, whose mailing address is 8251 East Granite Pass Rd., Scottsdale,
<br />AZ 85266, herein collectively referred to as "Trustor"; CATHLEEN H. ALLEN, Attorney-at-
<br />Law, hereinafter referred to as "Trustee", whose mailing address is P. O. Box 790, Grand Island,
<br />Nebraska 68802; and VIRGINIA R. RAUERT, hereinafter referred to as "Beneficiary", whose
<br />mailing address is c/o Patricia J. Hancock, Co-Conservator of Virginia R. Rauert, 5938 N. 80
<br />Rd., Cairo, NE 68824.
<br />For valuable consideration, Trustor irrevocably grants, transfers, conveys and assigns to
<br />Trustee, in trust, with power of sale, for the benefit and security of Beneficiary, under and subject
<br />to the terms and conditions of this Deed of Trust, the Trustor's interest in the following-described
<br />property located in Hall County, Nebraska, to-wit:
<br />All of Grantor's interest in the South Half of the Northwest Quarter (S'/zNW %) of
<br />Section Thirty One (31), Township Twelve (12) North, Range Ten (10) West of
<br />the 6th P.M., Hall County, Nebraska EXCEPT a certain tract more particularly
<br />described in Return of Appraiser recorded in Book U, Page 228 EXCEPT a tract
<br />more particularly described in Warranty Deed recorded as Document No. 83-
<br />005825 EXCEPT Lot One (1), Fagan Subdivision, Hall County, Nebraska,
<br />together with all improvements, fixtures and appurtenances located thereon or in any way
<br />pertaining thereto, and the rents, issues, profits, reversions and the remainders thereof, including
<br />all such personal property that is attached to the improvements so as to constitute a fixture, all of
<br />which, including replacements and additions thereto, are hereby declared to be a part of the real
<br />estate conveyed in trust hereby, it being agreed that all of the foregoing shall be hereinafter
<br />referred to as the "Property".
<br />FOR THE PURPOSE OF SECURING:
<br />(a) the payment of indebtedness evidenced by the note of even
<br />date herewith executed by Patricia J. Hancock in the principal sum of
<br />THIRTY SIX THOUSAND NINE HUNDRED EIGHTY-THREE AND
<br />91/100 DOLLARS ($36,9$3.91), together with interest at the rate provided
<br />therein, or the principal and interest on any future advance not to exceed
<br />the total principal sum initially secured hereby as evidenced by promissory
<br />Hates stating they are secured hereby, and any and all renewals, modifi-
<br />cations and extensions of such notes, both principal and interest on the
<br />notes being payable in accordance with the terms set forth therein, which
<br />by this reference is hereby made a part hereof;
<br />(b) the payment of indebtedness evidenced by the note of even
<br />date herewith executed by Peggy J. Radford in the principal sum of
<br />THIRTY SIX THOUSAND NINE HUNDRED EIGHTY-THREE AND
<br />91/1Q0 DOLLARS ($36,983.91), together with interest at the rate provided
<br />therein, or the principal and interest on any future advance not to exceed
<br />the total principal sum initially secured hereby as evidenced by promissory
<br />notes stating they are secured hereby, and any and all renewals, modifi-
<br />cations and extensions of such notes, both principal and interest on the
<br />notes being payable in accordance with the terms set forth therein, which
<br />by this reference is hereby made a part hereof;
<br />(c) the performance of each agreement and covenant of Trustor
<br />herein contained; and
<br />(d) the payment of any sum or sums of money which maybe
<br />hereafter paid or advanced by Beneficiary under the terms of this Deed of
<br />Trust, together with interest thereon at the rate provided in the note.
