<br />NOTICE IS HEREBY GIVEN that DONALD W. PEDERSON, the Trustee named in that certain Deed of
<br />'Trust dated September 23, 1994, wherein ROBERT L. SIEMERS and BET"I"Y SIE;'MF'RS, husband and wife, is Trastor and
<br />RONALD A. PAXTON and VICTOR PAXTON is Beneficiary, and wherein said Tn~stor transferred, conveyed and assigned
<br />with power of sale to said Trustee, in trust for said Beneficiary the following described real estate, to-wit:
<br />The Northeast Quarter of the Southeast Quarter (NE1/4SE1/4) and the Southeast Quarter of the Southeast
<br />Quarter (SE 1 /4SI;1 /4) of Section "I"hree (3), Township Twelve (12) North, Range Ten (I 0) West of the Sixth
<br />P.M., Hall County, Nebraska,
<br />which was recorded on September 27, 1994, as Document No. 94-107990 of the microfilm records of the Register of Deeds of
<br />Hall County, Nebraska, has elected to sell or cause to be sold the above described real estate to satisfy the obligation of'the
<br />"1'rustor to Beneficiary created by a certain promissory note executed and delivered by'1'c~ustor to Beneficiary dated September
<br />23, 1994, which has been breached on account of the failure of the Tr~.istor to pay the same, which said Deed ofTrust was gi~ren
<br />to secure.
<br />Trustors have breached the obligation for which the Trust Estate was conveyed as security. The nature of the
<br />breach is as follows: Failure to pay the note in full upon demand,
<br />Trustee has elected to declare the entire unpaid balance, together with the interest thereon, immediately due
<br />and payable and has elected to sell or cause to be sold the Trust Estate described in the "Trust Deed to satisfy Trustors' obligation
<br />to Beneficiary.
<br />NOTICE OF RIGHT TO CURE DEFALJLT
<br />TO: 'Trustors, their successors in interest in the "Trust Estate or any part thereof, any other person having a subordinate lien
<br />or encumbrance of record thereon, and any beneficiary under a subordinated trust deed:
<br />You are hereby notified:
<br />1. Under Nebraska law, you have the right to remove the default within two months of the date of this Notice was filed for
<br />record in the office of the Register of Deeds as provided in Nebraska Revised Statutes § 7G-1012;
<br />2. The entire unpaid principal sum secured by the Trust Deed is $320,970.53;
<br />3. The amount of interest accrued on the sum described in 2 above, as of December 10, 2009, is $0. From and after that
<br />date, interest is accruing on said sum in the amount of $70.35 per day;
<br />4. The amount of unpaid principal which would now be due had there been no default is $320,970.53.
<br />Be advised that nothing in this Notice is intended to waive or to otherwise relinquish any rights or defenses Beneficiary may have
<br />under the law with regard to any promissory notes, trust deeds, financing statements, security agreements, mortgages, or any other
<br />agreement co~icerning this loan.
