Division Street, <br />Grand Island, NE 6$801 <br />You are hereby given Notice of Default under a Deed of Trust <br />executed by DOREEN S. KOSMICKI a/k/a DOREEN HARMES, a married <br />person, and EUGENE M. KOSMICKI, her husband, dated January 14, <br />2004, and recorded January 26, 2004, as Document No. 0200400725 in <br />the Office of the Register of Deeds of Hall County, Nebraska; said <br />Deed of Trust securing the following property: <br />LOT FIVE (5) IN O'NEILL SUBDIVISION, BEING A SUBDIVISION <br />OF A PART OF BLOCK THREE (3), PLEASANT HONE SUBDIVISION, <br />CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA, more commonly <br />known as 1219 S. Sylvan Street, Grand Island, Nebraska <br />68801 <br />said Deed of Trust being in favor of Five Points Bank, a Nebraska <br />Banking Corporation,. Trustez and Beneficiary under said Deed of <br />Trust. <br />Said default under the terms of said above Deed of Trust <br />has occurred by virtue of nonpayment of the payments as they <br />became due and payable under an Extension and Modification <br />Agreement, No. 780341, of a previous Promissory Note dated August <br />5, 2008, in a .remaining sum of NINE THOUSAND FOUR HUNDRED SEVENTY <br />FOUR DOLLARS and FIFTY SEVEN CENTS ($9,474.57), together with <br />interest, payable in monthly installments of Twa Hundred Fifty <br />Dollars ($250.00).. with. the first payment due August 20, 2008, and <br />a like payment on the same day of each month thereafter until <br />maturity on July 10, 2009, when all ..remaining principal and <br />interest is due.' There is now due the principal balance of Eight <br />Thousand Eight Hundred Eighty Three Dollars and Six Cents <br />($8,883.06), together with interest of Four Hundred One Dollars <br />and Fifty Eight Cents ($401.58), for a total due of NINE THOUSAND <br />SIX HUNDRED SIXTY EIGHT DOLLARS and SEVENTY THREE CENTS <br />($9,668.73), together with late charges of Three Hundred Eighty <br />Four Dollars and Nine Cents ($384.09) and per diem interest <br />accruing at the rate of $2.15 per diem. <br />Trustors are hereby liable to Trustee, Five Points Bank, <br />for all fees and costs associated with this default and recovery <br />pursuant to Nebraska Statute §76-1012. <br />By virtue of said default, Trustee, Five Points Bank, has <br />determined to sell or cause to be sold the trust property to <br />satisfy the obligations referred to above. <br />The default may' be cure <br />filing of this- Notice, and the <br />may be thereby reinstated as <br />1:012. <br />d within thirty (30) days of the <br />obligations of the Deed of Trust <br />provided in Nebraska Statute §76- <br />DATED: December 3, 2009. <br />
