LEASE AGREEMENT 2 0 o s o 91 i 3 <br />THIS AGREEMENT made this 16~' day of June, 2009, by and between the Pawnee <br />Nation of Oklahoma, hereinafter referred to as the "Landlord," and Jack Reed, hereinafter <br />referred to as the "Tenant". The Landlord leases to the Tenant the premises located at 3501 South <br />Engleman Road, Grand Island, Hall County, Nebraska, and containing 21.980 acres, more or less. <br />1. TERM. The initial term of this Lease shall be approximately ten (10) years <br />beginning on June 1, 2009, and ending May 31, 2019, at 12:00 noon. <br />2. RENT. Total rent is Ten Dollars ($10.00), per year during the term of this <br />Lease. In addition thereto, the Tenant agrees to pay any property tax levied on the property <br />during the term of the Lease and any special assessments which are due during the course of the <br />Lease. <br />3. FAILURE OF LANDLORD TO ACT. Failure of the Landlord to insist <br />upon strict compliance with the terms of this Agreement shall not constitute a waiver of any <br />violation. <br />4. RENEWAL TERM. Either party may terminate this Agreement at the end <br />of the term by giving the other party thirty (30) days written notice prior to the end of the term. If <br />no notice is given, then this agreement will be extended on a month-to-month basis at the then <br />prevailing rental rate, plus amonth-to-month short-term lease premium. Tenant may renew the <br />Lease for an additional ten-year period on the same terms and conditions by giving the Landlord <br />written notice on or before November 30, 2019. <br />5. SUBLET. Tenant may not sub-let the premises or assigri this Lease. <br />6. RIGHT TO ACCESS. Tenant agrees to permit the Landlord, or his agent, to <br />enter the premises from time to time in order to inspect the premises, make necessary or agreed <br />repairs, decorations, alterations, or improvements; supply agreed services, or exhibit the premises <br />to prospective or actual purchasers, mortgages, tenants, workmen or contractors, or in the event of <br />an emergency. <br />7. PROPERTY LOSS. Landlord shall not be liable for theft or any damages to <br />Tenant's property of any type for any reason or cause whatsoever. Tenant agrees to obtain tenant <br />insurance to protect household goods and personal effects, as well as liability insurance. <br />$. INDEMNIFICATION. Tenant releases Landlord from Liability for and <br />agrees to indemnify Landlord against all losses incurred by Landlord as a result of (a) Tenant's <br />failure to fulfill any condition of this Agreement; (b) any damage or injury happening in or about <br />the premises to Tenant's invitee or licensees, or such person's property; (c) Tenant's failure to <br />comply with any requirements imposed by any governmental authority; and, (d) any judgment, <br />lien, or other encumbrance filed against the property as a result of Tenant's action. <br />9. FIRE. If the premises, or any part thereof, shall, at any time during the term, <br />be destroyed by fire not the fault of the Tenant, or by storm, then the payment of the rent hereby <br />reserved, or proportionate part thereof, according to the extent of the damage incurred, shall be <br />suspended until the premises shall have been reinstated and rendered fit for habitation. <br />10. ABANDONED PROPERTY. Any and all property of Tenant which may <br />be left in the premises or on the property after termination of occupancy, the Tenant's right of <br />possession for any reason may be handled, removed, ar otherwise disposed of by Landlord at the <br />risk and expense of the "Tenant, and Landlord shall in no event be responsible for any property left <br />an the premises by Tenant. <br />11. RULES AND REGULATIONS. <br />A. UTILITIES. Tenant shall pay all utilities, except as otherwise told. <br />B. LAWN AND PARKING. All watering and mowing of the lawn will be <br />done by Tenant. All leaves and lawn clippings will be disposed of by Tenant. <br />12. ENTIRE AGREEMENT. This Agreement and any attached addendums <br />constitute the entire agreement between the parties and no oral statements shall be binding. <br />IN WITNESS WHEREOF the parties hereto have caused these present to be signed in <br />person or by a person duly authorized, the day and year first above written. <br />ti%e, the Tenants; acknowiudge that we are each, jointly and severalip, responsible for <br />performance of all covenants, terms, and conditions of the Lease.
