CF7 ~ AFFIDAVIT OF SCRIVENER'S ERROR I, Melinda Kroeger, being the scrivener of the below referenced Deed of Trust and Assistant Secretary for AXIS Capital, Inc., a Nebraska corporation ("Lender"), with respect to the below referenced Deed of Trust, first being duly sworn upon my oath, state as follows: 1. That certain Deed of Trust, Security Agreement, Assignment of Leases and Rents, Financing Statement and Fixture Filing (the "Deed of Trust"), which was executed by Nall, Inc., a Nebraska corporation ("Borrower") in favor of Lender on March 13, 2008 and recorded on March 14, 2008, as Instrument Number 0200802163 in the Office of the Register of Deeds of County of Hall, Nebraska, incorrectly identifies Lender as "AXIS Capital, LLC." 2. The purpose of this affidavit is to hereby correct all references to Lender, which are contained within the Deed of Trust, so that such references correctly identify Lender as "AXIS Capital, Inc." 3. The Deed of Trust encumbers certain real property described in Exhibit "A" attached hereto, and incorporated by reference herein.
