<br />KNOW ALL MEN BY THESE PRESENTS that GREGORY L. GALLES, is the ---~--
<br />Successor Trustee under a Deed of Trust made and entered into on ar about February 28, 2005, by ~~,

<br />Trust was recorded on March 4, 2005 as Instrument No. 2005-01875 of the Mortgage Records of
<br />Hall Caunty, Nebraska. Said Deed of Trust having been assigned by virtue of an Assignment dated
<br />February 28, 2005 to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., and
<br />which was filed for record on April 5, 2005 as Instrument No. 2005-03009 and subsequently
<br />assigned to U.S. BANK, N.A., by virtue of an assignment dated April 14, 2009 and filed for record
<br />on April 20, 2009, as Instrument No. 2009-02958 of the Mortgage Retards of Hall Caunty,
<br />Nebraska. GREGORY L. GALLES was appointed Successor Trustee by virtue of a Substitution. of

<br />($83,688.92) and other good and valuable consideration received fraixa. U.S. BANK, N.A., does
<br />hereby grant, bargain, sell, convey and confirm unto U.S. BANK, N.A., (hereinafter "Grantee" where

<br />to have and to hold the above-described premises together with all tenements, hereditaments and
<br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever.
<br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns:
<br />That KEVIN J. SAMWAY and ANGELA K. SAMWAY, as Trustors, failed to pay to
<br />Beneficiary payments which were contractually due, and the Grantor, at the request of the
<br />Beneficiary, elected to declare the entire unpaid principal balance, together with interest
<br />thereon at once immediately due and payable.
<br />2. That Kevin Samway and Angela Samway filed their Chapter 7 Bankruptcy Petition on April
<br />29, 2009 and iJ.S.l3anlc, N.A. obtained relieffroin the Bankruptcy Stay on June 18, 2009. A
<br />copy of said Order is attached hereto and marked as Exhibit "A".
<br />3. That a Notice of Default as required by § 76-1006 was filed by Grantor on July 6, 2009, as
<br />Instrument No.2009-05422 in the Office of the Register of Deeds of Hall County, Nebraska.
<br />A copy of said Notice of Default was thereafter mailed to all parties entitled to notice,
<br />pursuant to said Deed of Trust and in compliance with § 76-1008, R.R.S. Nebraska. ~~,
