<br /> WHEREAS, Virginia M. Arvizo and Alfonso Arvizo, wife and husband, as
<br /> trustors, on May 30, 2007, did make, constitute and deliver to Richard T.
<br /> Seckman, Attorney at Law, as trustee and Eugene J. Jedlicka and Carol A.
<br /> Jedlicka, husband, and wife, as beneficiaries, a Deed of Trust conveying the
<br /> following described real estate, to-wit:
<br /> Part of the Northwest Quarter of the Northwest Quarter (NW1/4NW1/4) of Section
<br /> Twe4X-Two (22), Township Eleven (11) North, Range Nine (9)*West of the 6th P.M.,
<br /> in Hall County, Nebraska, more particularly described as follows:
<br /> Beginning at a point Forty Feet (401) East and Five Hundred Eighty-Two Feet
<br /> (582') South of the Northweet Corner of said Section 22, Township 11 North, Range
<br /> 9 West, thence due East One Hundred Thirty-Two Feet (1321) parallel with the
<br /> North line of said Section; thence due South parallel with the West line of said
<br /> Section 22, Sixty-Six Feet (661); thence due West parallel with the North line of
<br /> said Section 22, One Hundred Thirty-Two Feet (132'); thence North and parallel
<br /> with the West line of said Section 22, Sixty-Six Feet (661) to the point of
<br /> beginning (Said Tract formerly being described as Lot Five (5) in Block Six (6),
<br /> South Grand Island.) Excepting therefrom the Warranty Deed recorded at Book 164,
<br /> Page 29, in the office of the Register of Deeds, Hall County, Nebraska,
<br /> WHEREAS said Deed of Trust was given for security for the payment of
<br /> that Promissory Note dated May 30, 2007, in the principal amount of
<br /> $113,000.00, requiring monthly payments. That said Deed of Trust was recorded
<br /> on May 30, 2007, at 11:37 a.m. as Instrument No. 0200704418, with the Register
<br /> of Deeds of Hall County, Nebraska.
<br /> WHEREAS, a breach of the obligation of the trustors for which said Deed
<br /> of Trust was granted, has occurred, to-wit: Failure to make monthly payments,
<br /> failure to pay real estate taxes and failure to maintain proper insurance for
<br /> the real estate.
<br /> THEREFORE, notice of default is hereby given that the trustee, Richard
<br /> T. Seckman, Attorney at Law, at the request of the beneficiaries, Eugene J.
<br /> Jedlicka and Carol A. Jedlicka, husband and wife, has elected to sell the real
<br /> estate above described in said Deed of Trust to satisfy the obligations. Such
<br /> sale shall not take place in the event payment is made of all principal and
<br /> interest payments to the current date with regard to said Promissory Note, and
<br /> payment of all real estate taxes due, including reimbursement of same to the
<br />
<br /> ene b ficiaries which beneficiaries advance on trustors' obligation's as"iell as
<br /> reimbursement and payment to beneficiaries of all insurance on the subject
<br /> premises, together with expenses of this default proceeding including trustee
<br /> and attorney fee, within one month of the filing for record of this Notice of
<br /> Default.
