2000'7687 C. The parties desire to approve and consent to certain matters with respect to the Final Flat and construction of the Verizon cellular store as required by the Declaration. Agreement Now, therefore, in consideration of the foregoing Recitals which are incorporated herein by this reference, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereby agree as follows: Recitals. Except as set forth herein, the recitals are incorporated herein as if set forth in full. 2. Capitalized Terms. All capitalized terms shall have the meanings respectively given to them in the Original Declaration. 3. Approval of Plans; Verizon Building .Envelope. Allen 2$1 and GIV hereby approve the Final Plat shown on Exhibit "A". Pursuant to Sections 2.3(a), 4.3(d)(iii) and 5.4 of the 1999 Declaration, Allen 281 and GIV hereby approve the Verizon Building Design Drawings, the location and height of the proposed Verizon building and parking, and the location of the trash enclosure for the Verizon Parcel as depicted on Exhibit "B" attached hereto. Pursuant to Section 2.1(b) of the 1999 Declaration, Allen 281 and GIV hereby approve the Common Area improvements located within the Building Envelope on the Verizon Parcel. 4. Revised Building. Envelope. Pursuant to Section 2.1(d) of the 1999 Declaration, Allen 281 and GIV hereby approve and consent to (i) the reconfiguration of Parcels 17 and 18 as depicted on Exhibit "A" (the "lot line adjustment") with Parcels 17 and 18, as reconfigured, referred to herein and on Exhibit "A" respectively as Lot 1 Seventh Subdivision and Lot 2 Seventh Subdivision, and (ii) the future consolidation, if any, of Lot 1 Seventh Subdivision and Parcel 16 as permitted in the Declaration. The Building Envelope square footage far Parcels 17 and 18 as set forth on Exhibit "A" to the Declaration are hereby revised and amended to permit and assign a Building Envelope of seven thousand five hundred (7,500) square feet for Lot 1 Seventh Subdivision, and four thousand five hundred (4,500) square feet for Lot 2 Seventh Subdivision. 5. Counterparts. This Approval may be executed in two (2) or more counterparts, each of which shall be deerr~ed an original, and all of which together shall constitute one and the same agreement. 6. Ratification. Except as amended herein, the Declaration remains in full force and effect and the parties hereby ratify and confirm the Declaration as amended hereby.
