2000'7687 <br />C. The parties desire to approve and consent to certain matters with respect to the <br />Final Flat and construction of the Verizon cellular store as required by the Declaration. <br />Agreement <br />Now, therefore, in consideration of the foregoing Recitals which are incorporated herein <br />by this reference, and for other good and valuable consideration, the receipt and sufficiency of <br />which is hereby acknowledged, the parties hereby agree as follows: <br />Recitals. Except as set forth herein, the recitals are incorporated herein as if set <br />forth in full. <br />2. Capitalized Terms. All capitalized terms shall have the meanings respectively <br />given to them in the Original Declaration. <br />3. Approval of Plans; Verizon Building .Envelope. Allen 2$1 and GIV hereby <br />approve the Final Plat shown on Exhibit "A". Pursuant to Sections 2.3(a), 4.3(d)(iii) and 5.4 of <br />the 1999 Declaration, Allen 281 and GIV hereby approve the Verizon Building Design <br />Drawings, the location and height of the proposed Verizon building and parking, and the location <br />of the trash enclosure for the Verizon Parcel as depicted on Exhibit "B" attached hereto. <br />Pursuant to Section 2.1(b) of the 1999 Declaration, Allen 281 and GIV hereby approve the <br />Common Area improvements located within the Building Envelope on the Verizon Parcel. <br />4. Revised Building. Envelope. Pursuant to Section 2.1(d) of the 1999 Declaration, <br />Allen 281 and GIV hereby approve and consent to (i) the reconfiguration of Parcels 17 and 18 as <br />depicted on Exhibit "A" (the "lot line adjustment") with Parcels 17 and 18, as reconfigured, <br />referred to herein and on Exhibit "A" respectively as Lot 1 Seventh Subdivision and Lot 2 <br />Seventh Subdivision, and (ii) the future consolidation, if any, of Lot 1 Seventh Subdivision and <br />Parcel 16 as permitted in the Declaration. The Building Envelope square footage far Parcels 17 <br />and 18 as set forth on Exhibit "A" to the Declaration are hereby revised and amended to permit <br />and assign a Building Envelope of seven thousand five hundred (7,500) square feet for Lot 1 <br />Seventh Subdivision, and four thousand five hundred (4,500) square feet for Lot 2 Seventh <br />Subdivision. <br />5. Counterparts. This Approval may be executed in two (2) or more counterparts, <br />each of which shall be deerr~ed an original, and all of which together shall constitute one and the <br />same agreement. <br />6. Ratification.
