HEMMINGSEN and SHARON A. HEMMINGSEN, husband and wife, Grantor, in <br />consideration of One Dollar ($1.00) and other valuable consideration, receipt of which is hereby <br />acknowledged, convey to TIERONE BANK, Grantee, the following described real estate (as defined in <br />Neb. Rev. Stat. §76-201) in Douglas County, Nebraska: <br />"Lot Eight (8), Indianhead Seventh Subdivision, in the City of Grand Island, Hall County, <br />Nebraska.." <br />This deed is an absolute conveyance, the Grantor having conveyed said land to the <br />Grantee for a fair and adequate consideration, such consideration being the partial release of <br />personal liability of the Grantor upon the obligations and indebtedness secured by the Deed of <br />Trust dated and recorded January 10, 2007 as Instrument No. 200700272, Mortgage Records in <br />the Register of Deeds Office of Hall County, Nebraska. <br />Grantor declares that this conveyance is freely and fairly made and Grantor further <br />declares to Grantee that notwithstanding Grantor's right of redemption and/or other remedies, if <br />any, which may exist, Grantor desires to execute and deliver this Deed to Grantee. <br />Grantor further acknowledges that notwithstanding any provision in this Deed to the <br />contrary, this Deed shall not operate as a merger of the foregoing Deed of Trust in and to the fee <br />simple title conveyed by this Deed. <br />Grantor covenants (jointly and severally, if more than one) with the Grantee that Grantor: <br />(1) is lawfully seised of such real estate and that it is free from encumbrances except subject <br />to easements, reservations, covenants and restrictions of record; existing and subsequent real estate taxes <br />and assessments and the above-described Deed of Trust. <br />(2) has legal power and lawful authority to convey the same; and <br />(3) warn will defend the title to the real estate against the lawful claims of all <br />persons. <br />Dated thi~~day" f ~ ~~!'2009.
