~ ' 2009~1"73~~ AGREEMENT TO MODIFY PROTECTIVE COVENANTS, RESTRICTIONS AND CONDITIONS FOR DICKEY SUBDIVISION LOCATED IN HALL COUNTY, NEBRASKA WHEREAS, an Agreement for Protective Covenants, Restrictions and Conditions for Dickey Subdivision located in Hall County, Nebraska was filed on 7uly 21, 1964 in Book 13 at Page 269 of the Miscellaneous Records on file at the Register of Deeds Office in Hall County, Nebraska. WHEREAS, an Agreement to Modify Restrictions for Dickey Subdivision located in Hall County, Nebraska was recorded on August 24, 1966 in Book 15 at Page 469 of the Miscellaneous Records on file at the Register of Deeds Office in Hall County, Nebraska. WHEREAS, an Agreement to Modify Protective Covenants, Restrictions and Conditions for Dickey Subdivision located in Hall County, Nebraska was recorded on November 7, 1978 as Document No. 78-007314 at the Register of Deeds Office in Hall County, Nebraska. WHEREAS, the undersigned are a majority of the owners of said lots and desire to modify the Protective Covenants, Restrictions and Conditions for "Dickey Subdivision" as set forth herein. NOW, THEREFORE, in consideration of the premises and of the mutual modification of restrictions as set forth hereinafter, Protective Covenants, Restrictions and Conditions for "Dickey Subdivision" are changed and modified in the following particulars, to-wit: Paragraph (14) thereof is hereby amended to read as follows: "These covenants, restrictions and conditions are to run with the land and shall be binding on all persons owning or granting ownership of any of said lots in said subdivision until August 31, 2009, at which time said covenants, restrictions and conditions shall terminate and be considered null and void." This Agreement shall be binding on the parties hereto, and their respective heirs, executors, administrators and assigns.
