Lindquist, a member of <br />the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", pursuant to a <br />power of sale contained in that certain Deed of Trust recorded on July 16, 2007 as Instrument No. <br />0200705972 in the office of the Register of Deeds of Hall County, Nebraska, and the Secretary of <br />the Department of Housing and Urban Development, hereinafter called "Grantee". <br />WHEREAS, an April 3, 2009, Grantor, executed a Notice of Default pursuant to which <br />notice was given to Jack R. Hiatt and Victoria A. Hiatt, husband and wife, Trustors, under that <br />certain Deed of Trust recorded an July 16, 2007 as Instrument No. 0200705972 in the office of the <br />Register of Deeds of Hall County, Nebraska, covering that certain premises described as: <br />LOT FOUR AND THE SOUTH TWENTY FEET OF LOT FIVE, IN BLOCK <br />ONE, BURGER'S ADDITION TO THE VILLAGE OF DONIPHAN, HALL <br />COUNTY, NEBRASKA, <br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting <br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy <br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of <br />Hall County, Nebraska, on Apri17, 2009, as Instrument No. 0200902548. <br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice <br />pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §76-1008. <br />Subsequent thereto, beginning on May 13, 2009, Grantor caused to be published in The <br />Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a <br />Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the <br />described property would be sold at public auction to the highest bidder far cash ar certified or <br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1st & Locust Street, Grand <br />Island, Hall County, Nebraska at 2:00 p.m. on June 25, 2009. Publication of such notice was made <br />for five consecutive weeks an May 13, 2009, May 20, 2009, May 27, 2009, June 3, 2009 and June <br />10, 2009, the last publication being at least ten (10) days but not more than thirty (30) days prior to <br />the date of sale. <br />A copy of such notice of the time and place of sale was thereafter mailed to all parties <br />entitled to notice pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. §76-1008. <br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Grantor, did at <br />the time and place mentioned in said Notice of Trustee's Sale, offer said property for sale at public <br />auction, and did sell the same to Mortgage Electronic Registration Systems, Inc., as Nominee, for <br />the sum of $120,146.48, it being the highest bidder therefor. Mortgage Electronic Registration <br />Systems, Inc., as Nominee, has assigned all of its right, title and interest in such bid to Grantee. <br />NOW, THEREFORE, in consideration of the premises and of the sum of $120,146.48 so <br />bid and paid as aforesaid, I, Grantor, do hereby grant and convey unta said Grantee, its successors <br />and assigns forever, all the estate, right, title and interest of which the said Jack R.
