200501885 <br />1.2 ADDRESS. The address of the Subject Property (if known) is: generally, the NE <br />Corner of Old Potash Road and US Highway 281, Grand Island, Nebraska. <br />However, neither the failure to designate an address nor any inaccuracy in the <br />address designated shall affect the validity or priority of the lien of this Deed of <br />Trust on the Subject Property. <br />1.3 MODIFICATIONS TO THE SUBJECT PROPERTY. Grantor intends to <br />modify the description of the Subject Property attached hereto as Exhibit A <br />subsequent to the recording of this Deed of Trust. Upon such modification, with <br />any and all required approvals, the legal description of the Subject Property will <br />then be legally changed to read as set forth in Exhibit B attached hereto and from <br />and after such time the Subject Property encumbered by the Deed of Trust shall <br />be as described in Exhibit B. Should for any reason the legal description, when <br />changed, be different than as set forth in Exhibit B, Grantor agrees to cooperate <br />and execute such amendments and take such other actions as are required to <br />properly reflect the correct legal description of the Subject Property for this Deed <br />of Trust. Upon the legal description of the Subject Property being changed, <br />Grantor shall have an endorsement issued to the mortgagee's title insurance <br />policy for benefit of the Beneficiary regarding the Subject Property confirming <br />the continuance of such insurance with the changed legal description of the <br />Subject Property. <br />ARTICLE 2. OBLIGATIONS SECURED <br />2.1 OBLIGATIONS SECURED. Grantor makes this Deed of Trust for the purpose <br />of securing the following obligations ( "Secured Obligations "): <br />(a) Payment to Beneficiary of all sums at any time owing under that certain <br />Promissory Note ( "Note ") dated of even date herewith, in the principal <br />amount of Seventeen Million Fifty -Seven Thousand and 00 /100ths Dollars <br />($17,057,000.00) executed by Grantor, and payable to the order of <br />Beneficiary, as lender; and <br />(b) Payment and performance of all covenants and obligations of Grantor <br />under this Deed of Trust; and <br />(c) Payment and performance of all covenants and obligations under that <br />certain Building Loan Agreement ( "Loan Agreement ") dated of even date <br />herewith by and between Grantor and Beneficiary, as lender; and <br />(d) Payment and performance of all covenants and obligations, if any, of any <br />rider attached as an Exhibit to this Deed of Trust; and <br />(e) Payment and performance of all future advances and other obligations that <br />the then record owner of all or part of the Subject Property may agree to <br />pay and/or perform (whether as principal, surety or guarantor) for the <br />3 <br />#1060655 v4 <br />
