Hurst and Lora L. Hurst, husband & wife <br />hereinafter referred to as "Mortgagors /Trustors" did on the 3rd day of April, 2003 execute and deliver to Delbert D. <br />Hurst A mortgage /Deed of Trust upon certain real estate located in Hall County, Nebraska and legally described as: <br />SEE EXHIBIT "A" <br />Conditioned for and secure to the payment of the sum shown on the NOTE, which mortgage/Deed of Trust was <br />recorded in the Office of the Register of Deeds of Hall County on the 4t' day of April 2003 as Instrument No. <br />0200304034. <br />WHEREAS, Mortgagors /Trustors, for the purpose, among other things, of paying or securing certain debts, <br />have agreed to execute and deliver a mortgage /Deed of Trust upon the real estate to BankFirst conditioned for the <br />payment of the sum of Forty thousand and no /100 to be a First Mortgage/Deed of Trust upon the premises, recorded in <br />the Register of Deeds Office Hall County Nebraska Instrument No. 0200411578. <br />NOW, THEREFORE, Delbert D. Hurst in consideration of the premises for the value received, the receipt and <br />adequacy of which is hereby acknowledged, does hereby bargain, consent, promise and agree to and with <br />Mortgagors /Trustors, their heirs and assigns, that the mortgage/Deed of Trust upon the premises thus to be executed by <br />Mortgagors /Trustors to Delbert D.
