The Company and Allen Webb Road LLC, a Nebraska limited liability company <br />("Developer"), entered into that certain Developer Repurchase Agreement with respect to the Property dated <br />August 15, 2008, recorded with the office of the Register of Deeds of Hall County, Nebraska, as Instrument <br />No. 200807159 (the "Repurchase Agreement"); <br />3. Pursuant to the Repurchase Agreement, m the event the Company or its successors and assigns ` <br />do not cause the substantial completion of a Walgreens Drug Store and open for business within twenty-four <br />(24) months from August 1 S, 2008, the Developer has the option to purchase the Property. <br />4.
