<br />SUBSTITUTION OF TRUSTEE AND DEED OF RECONVEYANCE
<br />WHEREAS, the undersigned Beneficiary is the owner and holder of a Secured
<br />Promissory Note secured by the Deed of Trust hereafter described;
<br />WHEREAS, the undersigned Beneficiary, being the present Beneficiary under said Deed
<br />of Trust, acknowledges that all of the sums and obligations secured by said Deed of Trust have
<br />been fully paid or satisfied; and
<br />WHEREAS, the Beneficiary desires to substitute Duane A. Burns, Attorney at Law, as
<br />the trustee under said Deed of Trust, in the place or stead of Trustee originally named therein and
<br />hereby further directs such Successor Trustee to make a reconveyance in respect to such Deed of
<br />Trust.
<br />NOW, THERFORE:
<br />1. Substitution of Trustee. DUANE A. BURNS, Attorney at Law, a member of the
<br />Nebraska State Bar Association, whose mailing address is P.O. Box 2300, Grand Island, NE
<br />68802 -2300, is hereby appointed Successor Trustee under the Deed of Trust executed by
<br />Florence C. Greenwood, as Trustor, in which Robert Lloyd Minor and Marcella K. Minor,
<br />husband and wife, are named as the Beneficiary and Earl D. Ahlschwede, Attorney, as Trustee,
<br />dated January 3, 1994, and recorded January 4, 1994, in the Office of the Register of Deeds of
<br />Hall County, Nebraska (as Instrument No. 94- 100137) in regard to the following- described
<br />premises:
<br />The South Half of the Northwest Quarter (S1 /2NW1 /4) and the North Half of the
<br />Southwest Quarter (N1 /2SW1 /4), in Section Ten (10), Township Eleven (11)
<br />North, Range Ten (10) West of the 6th P.M., Hall County, Nebraska
<br />An Assumption Agreement was executed by and between Florence C. Greenwood and Little B's
<br />Corp., a Nebraska corporation, and Thomas Baxter and Elizabeth Baxter, dated January 3, 1994
<br />and recorded January 20, 1994, in the Office of the Register of Deeds of Hall County, Nebraska
<br />(as Instrument No. 94- 100589). The foregoing Deed of Trust secures the Secured Promissory
<br />Note dated January 3, 1994, a copy of which is attached hereto and incorporated herein by
<br />reference. The Secured Promissory Note is payable to Beneficiary and Marcella K. Minor,
<br />husband and wife, as joint tenants with right of survivorship. Marcella K. Minor is deceased and
<br />Beneficiary has all right, title and interest in the Deed of Trust and Secured Promissory Note as
<br />the surviving joint tenant. The Secured Promissory Note was paid in full on or before the due
<br />date of January 3, 1998.
<br />2. Direction for Reeonveyance. Beneficiary further instructs said Successor
<br />Trustee to reconvey, without warranty, all the estate now held under this Deed of Trust to the
<br />person or persons legally entitled thereto.
