20050161'7 <br />a residence. No unused building materials, junk or rubbish shall be left exposed on any lot <br />except during actual building operations. No farm equipment shall be stored or placed on the <br />property. <br />4. ARCHITECTURAL CONTROL. The Harder Estates Subdivision Association or its <br />designated committee shall have the architectural control and the responsibility for approving all <br />construction upon the lots. Construction shall include but not be limited to dwellings, additions <br />to or modification of any existing home, fences, secondary buildings, storm shelters, and site <br />storm drainage. <br />In the event the Harder Estates Subdivision Association, or its designated architectural <br />control committee, fails to approve or disapprove any design and location within thirty (30) days <br />following the submission of the plans and specifications to the Association, approval will not be <br />required and this Paragraph will be deemed to have been fully complied with. The owner or <br />constructor shall then obtain a building permit from the proper governing facility. <br />5. BUILDING REQUIREMENTS. No dwelling structure, garage or other incidental <br />building shall be built with scrap lumber, or moved on to the site, excluding a new modular <br />home. The dwelling structure shall be considered complete when at least one floor of living <br />space over the entire basement area is complete. Following are additional requirements: <br />A) Each dwelling shall have at least 1750 square feet of living space above ground, which shall <br />not include garage, breeze way or open or enclosed porches. <br />B) Each dwelling shall have a garage which will accommodate at least two cars. All garages <br />must be attached directly to the dwelling or connected thereto by a breeze way or similar <br />structure. <br />C) Each building shall have a minimum of 4 -12 pitch roof. <br />D) All structures shall be in earth tone colors. <br />E) All construction shall be completed within one year of the date commenced. <br />6. SETBACKS. All dwelling structures, unattached garage or other incidental building <br />shall be placed on the lot in accordance with the setback requirements of Hall County. All such <br />measurements shall be computed from the foundation of the structure to the nearest property line. <br />Driveways may be built within the setbacks if approved by the Harder Estates Subdivision <br />Association Architectural Committee in writing. <br />7. ADDITIONAL STRUCTURES. Except for Lot 4, one additional structure shall be <br />allowed besides the residence and the attached or unattached garage located next to the residence. <br />The unattached garage or incidental structure shall have a wood or metal frame covered with <br />wood, vinyl, colored steel. The structure's height shall not exceed the lesser of 20' or the height <br />of the primary residence, whichever is less. Square footage shall not exceed 900 square feet (the <br />size of a three car garage) and the front view of the building shall not exceed 26'. Any additional <br />structure shall be positioned such that it is farther from the cul -de -sac than the primary residence <br />for lots 3 -9. For lots 1 and 2 the residence shall face north and the additional structure shall be to <br />the south of the residence. <br />8. DRIVEWAYS. It shall be the responsibility of all property owners to build and <br />maintain their driveway of cement. The driveway shall be built in an acceptable way to all <br />parties involved, including County, State, Federal, and Utility employees who have need for <br />access to perform their duties. <br />9. UTILITY EASEMENTS as shown on the Dedication Plat are hereby established for <br />the future installation, maintenance, repair and replacement of utilities over, upon and under the <br />area as shown. These easements shall carry full Right -of- Access by the owners and operations of <br />these utilities. <br />10. ALL ELECTRIC AGREEMENT. All construction of residential units in the Harder <br />Estates Subdivision will use electricity as the source of utilities for heating, cooling, lighting, <br />cooking, water heating and any similar uses. <br />11. UTILITIES, EXPOSED AERIALS AND LINES, OUTDOOR LIGHTING. Certain <br />easements are established for installation and maintenance of utilities, such as easements being <br />
