<br />Covenants, Restrictions, and Conditions
<br />THIS DECLARATION is made on February 2005, by Joyce Harder a/k/a Joyce M.
<br />Harder, single and Joyce M. Harder and Diann Muhlbach, Co- Trustees of the Testamentary
<br />Irrevocable Credit Shelter Trust of Ralph F. H. Harder by Will dated April 23, 1993, hereinafter
<br />referred to as "Declarants ", for themselves, their successors, grantees and assigns:
<br />DECLARATION OF PURPOSE
<br />Declarants are the owners of real property in the County of Hall, State of Nebraska, which
<br />is more particularly described as:
<br />Lots one (1) through nine (9), Harder Estates Subdivision, Hall County, Nebraska
<br />which is in a tract of land located in the: Southwest Quarter (SWI /4) of Section Eighteen (18),
<br />Township Twelve (12) North, Range Eleven (I1),West of the 6th P.M., Hall County, Nebraska.
<br />WHEREAS, Declarants desire to provide for the construction of a planned residential
<br />area consisting of single family residences, including without limitation open spaces and
<br />recreational facilities; and
<br />WHEREAS, Declarants at this time include in this Declaration and impose the
<br />restrictions upon the common areas and lots of the property described above.
<br />NOW THEREFORE, Declarants hereby declare that the lots of the property described
<br />above, shall be held, sold and conveyed subject to the following reservations, easements,
<br />limitations, restrictions, servitudes, covenants, conditions, charges and liens (hereafter
<br />collectively termed "covenants and restrictions" which are for the purpose of protecting the value
<br />and desirability of lots one (1) through (9), comprising Harder Estates Subdivision and which
<br />shall run with the real property and be binding on all parties having any right, title or interest in
<br />one of the described lots, or any part thereof, their heirs, successors, assigns, and personal
<br />representatives, and which shall inure to the benefit of each Owner thereof.
<br />Article I.
<br />DEFINITIONS
<br />The following words, phrases or terms used in this declaration shall have the following
<br />definitions:
<br />1. ANNUAL ASSESSMENT shall mean the charge levied and assessed each year
<br />against each lot, owner or leasee pursuant to article IV, section (a), hereof.
<br />2. ARCHITECTURAL COMMITTEE shall mean the committee of the association to be
<br />created pursuant Article II, paragraph 4 below.
