<br />NOTICE IS HEREBY GIVEN that on the --day of February, 2005, Centex Home
<br />Equity Company, LLC, as the plaintiff, filed its Complaint in the District Court of Hall County,
<br />Nebraska, against Glen Kluthe, Bonnie Kluthe, Michael F. Kivett, Trustee, and Citifinancial, Inc.,
<br />Beneficiary, as the defendants, the object and prayer of such Complaint being to obtain an
<br />accounting, to foreclose a deed of trust given by said Glen Kluthe and Bonnie Kluthe, husband and
<br />wife, to American West Title, as Trustee, for the benefit of Homeowners Loan Corp., Beneficiary, to
<br />foreclose any interest in or lien upon the real estate hereinafter described of the above -named
<br />defendants, to obtain an order for the sale of the real estate hereinafter described for the satisfaction
<br />of the indebtedness secured by such deed of trust and to obtain other equitable relief, that such deed
<br />of trust is dated August 11, 2003, and was recorded August 20, 2003, as Instrument Number
