20O5O1432 <br />and plat of such proposed subdivision, to be known as PRAIRIELAND SUBDIVISION, <br />designating explicitly the land to be laid out and particularly describing the lots, easements and <br />streets belonging to such subdivision, with lots and blocks designated by numbers, easements by <br />dimensions and streets by names, and proposes to cause the plat of such subdivision when finally <br />approved by the Regional Planning Commission and the Alda Village Board to be acknowledged <br />by such owners, certified as to accuracy of survey by a registered land surveyor and to contain a <br />dedication of the easements to the use and benefits of public utilities, and of the streets to the use <br />and benefit of the public forever. In consideration of the acceptance of the plat of said <br />PRAIRIELAND SUBDIVISION, the Subdividers hereby consent and agree with the Village of <br />Alda, Nebraska that they will install or provide at their expense, and will abide by, the following <br />provisions to be applicable to this subdivision: <br />1. Deferral for Completion of Subdivision Infrastructure Improvements. The Village of <br />Alda, Nebraska in accordance with Section 5.01 of its Subdivision Regulations determined that, <br />by reason of distances existing structures are located from public utility connections; there being <br />essentially no change in the current use made of the parcel; and there being no immediate plan <br />by the Subdividers for commercial or residential development, it is impractical to (a) require the <br />immediate construction of Streets meeting all criteria specified in Section 7.01 of its Subdivision <br />Regulations; (b) require connection to Sanitary Sewer lines pursuant to Section 7.04 of its <br />Subdivision Regulations; or (c) require connection to Water lines pursuant to Section 7.05 of its <br />Subdivision Regulations. <br />2. Streets. In lieu of requiring the Subdividers to immediately pave and grade the right - <br />of -way to its full width as otherwise required by the Subdivision Regulations of the Village of <br />Alda, the Subdividers do hereby give, grant and convey unto the VILLAGE OF ALDA, <br />NEBRASKA, a municipal corporation, a turn - around easement upon that real estate described <br />as: <br />Begiming at the northeast corner of Lot Seven (7), Elrod Estates Subdivision, an <br />addition to the Village of Alda, Nebraska, said point also being on a west line of <br />said Lot One (1), Prairieland Subdivision, and the southeast corner on the <br />southeasterly end of Prairie Lane; thence S00 °00'19 "W, along and upon the east <br />line of said Lot Seven (7), Elrod Estates Subdivision, and also being along and <br />upon a west line of said Lot One (1), Prairieland Subdivision, a distance of Forty <br />One and Forty Two Hundredths (41.42) feet to a point of curvature; thence <br />running southeasterly, along and upon the arc of a curve to the left whose radius is <br />75.0 feet, a distance of Two Hundred Five and Twenty Six Hundredths (205.26) <br />2 <br />
