~• 2oosos437~ ARTICLE XIII RELIANCE BY THIRD PARTIES For the purpose of inducing any person or entity to act in accordance with the powers granted by this Power, 1 hereby represent, warrant and agree that 1 and my heirs, distributees, legal representatives, successors and assigns will hold such party or parties harmless from any loss suffered ar liability incurred by such party in acting in accordance with this Power. No person who acts in reliance upon any representations my Agent may make as to (a) the fact that my Agent's powers are then in effect; (b) the scope of my Agent's authority granted under this instrument; (c) my competency at the time this instrument is executed; (d) the fact that this instrument has not been revoked; or (e) the fact that my Agent continues to serve as my Agent shall incur any liability to me, my estate, my heirs or assigns for permitting my Agent to exercise any such authority, nor shall any person who deals with my Agent be responsible to determine or insure the proper application of funds or property. ARTICLE XIV DURABILITY PROVISIONS I declare that this Power of Attorney shall not be affected by my disability or incapacity, and that the authority granted herein shall continue during any period while I am disabled ar incapacitated. Furthermare, all such authority shall continue after my death, until notice of such death shall have been received by my Agent so that said Agent has actual knowledge of the fact that I have died. Any action taken in good faith by said Agent during any period while it is uncertain whether I am alive, before said Agent receives actual knowledge of my death, or, in any event, taken during any period while 1 am disabled or incapacitated, shall be as valid as if 1 were alive, competent, and not disabled.
