<br />200906338 <br />dated April 29, 2009, made by JPMargan Chase Bank, National <br />Association, as purchaser of the loans and other assets of <br />Washington Mutual Bank, formerly known as Washington Mutual Bank, <br />FA (the "Savings Bank") from the Federal Deposit Insurance <br />Corporation, acting as receiver for the Savings Bank and pursuant <br />to its authority under the Federal Deposit Insurance Act, 12 U.S.C. <br />1821(d), as Attorney in Fact for Deutsche Bank National Trust <br />Company, as Trustee for Lang Beach Mortgage Trust 2005-WL3, Grantor <br />was substituted as Trustee in place of C.E. Heaney Jr. The <br />Substitution of Trustee was recorded on May 6, 2009, as Instrument <br />No. 200903475 in the Office cf thy: Register of Deeds of Hall <br />County, Nebraska. The fulfillment of the fallowing conditions, as <br />specified in the Trust Deed, authorize this conveyance: <br />1. Breach and default were made under the terms of the Trust <br />Deed i.n the particular set forth in .the native of default <br />hereinafter referred to, which default continued until the time of <br />sale. <br />2. There was filed for record on May 6, 2009, as Instrument <br />No. 200903476, a Not~.ce of Default in the Office of the Register of <br />Deeds of Hall County, Nebraska, and of election to sell the <br />property to satisfy the obligations secured thereby and thereafter <br />notice of the filing of the Native of Default was sent in the <br />statutory manner to all persons entitled to a notice thereof. <br />3. That thereafter Notice of Trustee's sale was properly made <br />stating that Trustee would sell at public auction to the highest <br />bidder the property hereinb_fore describe3, fi~:ing the time and <br />place of the sale as July 22, 2009 at 10:00 o'clock A.M. in the <br />Lower Lobby of the Hall County Courthouse, Grand Island, Nebraska <br />and caused copies of saa~d notice to be published once a week for <br />five consecutive weeks in the Grand Island Independent, a legal <br />newspaper printed, published and of general circulation in the <br />County of Hall, Nebraska. The first date of publication was June <br />12, 2009, and the last day of publication was July 10, 2009. <br />Notice of such Trustee Sale was sent to the Trustars and all <br />persons entitled to notice thereof in accordance with applicable <br />-2- <br />
