<br />AN UNDIVIDED 1.6166 %% INTEREST; BRIAN C. MALK, TRUSTEE OF THE
<br />BRIAN C. MALK TRUST DATED FEBRUARY 3, 1981, AS TO AN UNDIVIDED
<br />1.2834 %% INTEREST; PETER A. ZARCADES, TRUSTEE OF THE PETER A.
<br />ZARCADES SEPARATE PROPERTY TRUST DATED OCTOBER 29, 1980, AS MAY
<br />BE AMENDED FROM TIME TO TIME, AS TO AN UNDIVIDED 1.8400% INTEREST;
<br />J. GERALD LIPSCHITZ AND ANN F. LIPSCHITZ, HUSBAND AND WIFE, AS
<br />COMMUNITY PROPERTY, AS TO AN UNDIVIDED 0.2600% INTEREST; all with a
<br />mailing address of 3655 Nobel Drive, Suite 650, San Diego, California 92122 (collectively
<br />referred to herein as "GRANTEE ").
<br />WITNESSETH:
<br />That for and in consideration of the sum of Sixteen Thousand Four Dollars and
<br />00 /100 ($16,004) cash in hand paid GRANTOR by GRANTEE, the receipt and adequacy
<br />of which are hereby acknowledged, GRANTOR hereby grants, bargains, sells and conveys
<br />to GRANTEE, all certain tract or parcel of land described on Exhibit A (the "Property "),
<br />which is attached hereto and made a part hereof, excluding all buildings, structures and
<br />improvements constructed thereon.
<br />TO HAVE AND TO HOLD the Property, as described on Exhibit A, together with
<br />all the tenements, hereditaments and appurtenances thereto belonging or in any way
<br />appertaining unto the GRANTEE, its successors and assigns, FOREVER.
<br />This conveyance is made subject to all legal highways, zoning laws, ordinances and
<br />regulations and to all restrictions, easements, rights of way, exceptions, reservations and
<br />conditions contained in prior instruments or record in the chain of title to the Property
<br />conveyed hereby.
<br />GRANTOR, insofar as it has the legal right to do so, does further release, remise
<br />and forever quitclaim unto GRANTEE all of GRANTOR'S right, title and interest, if any,
<br />in and to all roadways, streets, alleys, easements and rights of way adjacent to or abutting
<br />on the Property conveyed hereby.
