Buffalo is the owner of the following described real property: <br />Lot Two (2), Cedar Ridge First Subdivision, iari the City of <br />Grand Island, Hall County, Nebraska. <br />The area of this lot totals 47,239.76 sq. ft., and is referred to herein as "Buffalo <br />Property." <br />E. GR-PRP is the owner of the following described real property: <br />Lots One (1) and Two (2), Cedar Ridge Second Subdivision, ixi <br />the City of Grand Island, Hall Gounty, Nebraska. <br />The area of these lots totals 172,788.92 sq. ft., and are referred to herein as <br />"CR-PRP Property." <br />F. The GILD Property, IIlride Property, Buffalo Property, and CR-PRP Property gain <br />access to the public right-of--way designated as 13'~ Street through a common <br />private road known as Cedar Ridge Street which is owned by the Grantor and <br />legally described as Outlot A, Cedar Ridge Second Subdivision, City of Grand <br />Island, Hall County, Nebraska upon which the access easements described herein <br />are granted ("Easement Area"). <br />G. An Easement between 4Evergreen II, L.L.C., Grantor and Buffalo was recorded with <br />the Hall County Register of Deeds on September 8, 2006 as Instrument <br />No. 200608058. The parties desire to amend and restate the easement to provide <br />for the permanent ingress and egress to the GILD Property, Illride Property, <br />Buffalo Property and CR- PRP Property over the Easement Area and for the repair, <br />replacement, and maintenance of the Easement Area, as defined below. <br />Ix~. consideration of the mutual promises contained herein, the receipt and <br />sufficiency is hereby acknowledged, Grantor and Grantees agree as follows: <br />1.. Cracaxit of Easement. Grantor hereby grants to Grantees an easement to be <br />used by the Grantees in common with each other for purposes of ingress and egress over <br />the private road located oxx the Grantor Property known as Cedar Ridge Street slriown and <br />depicted on Exhibit "A" attached and incorporated by this reference and legally described <br />as Outlot A, Cedar Ridge Second Subdivision, Hall County, Nebraska (the "Easement <br />Area") .Each Grantee covenants and agrees to use the Easement Area irx a reasonable <br />manner in common with the other Grantees using the Easement Area for access to theix <br />respective properties. <br />2. Sind3ng E~'eet. The easements granted in this instrument are perpetual <br />and nonexclusive easements over such paved portion of the Grantor property as is <br />necessary and convenient for the Grantees, the:ur successors, assigns, tenants, licensees <br />and invitees to enter and exit the respective Grantee's property as described above.
