<br />NOTICE IS HEREBY GIVEN that on the day of July, 2009, The Bank of New York
<br />Mellon f/k/a The Bank of New York as successor to JPMorgan Chase Bank, N.A., as trustee for the benefit
<br />of the Certificateholders of Popular ABS, Inc. Mortgage Pass-Through Certificates Series 2005-D, as the
<br />plaintiff, filed its Complaint in the District Court of Hall County, Nebraska, against Janice Leetch, as the
<br />defendant, the object and prayer of such Complaint being to obtain an accounting, to foreclose a deed of
<br />trust executed by said Janice Leetch, an unmarried person, to Ticor Title Agency Company, Trustee, for
<br />the benefit of Mortgage Electronic Registration Systems, Inc., acting solely as Nominee for Popular
<br />Financial Services, LLC, Beneftciary, to foreclose any interest in or lien upon the real estate hereinafter
<br />described of the above-named defendant, to obtain an order for the sale of the real estate hereinafter
<br />described for the satisfaction of the indebtedness secured by such deed of trust and to obtain other
<br />equitable relief; that such deed of trust is dated September 29, 2005, and was recorded October 4, 2005, as
<br />Instrument Number 0200509900 in the Office of the Register of Deeds of Hall County, Nebraska, and
<br />conveyed to such beneficiary the following desa-ibed real estate situa±ed in i-Iall County, Nebraska, to-
<br />wit:
<br />LOT THREE (3), BLOCK TWELVE (12), GCLBERT'S SECOND ADDITION TO THE
<br />CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA;
<br />and that such deed of trust was sold, transferred, and assigned to the plaintiff, by written assignment
<br />recorded on July 10, 2009, as Instrument Number 0200905616 in the Office of the Register of Deeds of
<br />Hall County, Nebraska.
