200501143 <br />Restaurant from including three [3] or fewer video games as an incidental use to its <br />operations); <br />(xviii) Any training or educational facility, including, but not limited to, <br />beauty schools, barber colleges, reading rooms, places of instruction or other <br />operations catering primarily to students or trainees rather than to customers <br />(except that this provision shall not prohibit on -site employee training [whether for <br />employment at the Shopping Center or at another business location of such <br />Occupant] by an Occupant incidental to the conduct of its business at the Shopping <br />Center); <br />(xix) Any church, school, day care center or related religious or <br />educational facility or religious reading room; provided, however, day care centers <br />and learning centers such as "Score! Educational Centers" and "Sylvan Learning <br />Centers" shall be permitted on the Outlot Tracts situated to the west of Wilmar <br />Avenue; <br />(xx) Any massage parlor (except that this provision shall not prohibit <br />massages in connection with a beauty salon, health club or athletic facility); and <br />(xxi) Any casino or other gambling facility or operation, including but not <br />limited to, off -track or sports betting parlors, table games such as black -jack or <br />poker, slot machines, video gambling machines and similar devices, and bingo halls <br />(except that this provision shall not prohibit government sponsored gambling <br />activities or charitable gambling activities if such activities are incidental to the <br />business operation being conducted by the Occupant). <br />(b) "Retail Office" shall mean an office which provides services directly to <br />consumers (i.e., financial institutions, real estate agencies, stock brokerages, title company <br />and escrow offices, travel and insurance agencies, and medical, dental and legal clinics). <br />Without the prior written consent of the Approving Parties (which consent may be granted <br />or withheld in the sole and absolute discretion of the Approving Parties), the following <br />restrictions shall apply: <br />(i) the only offices which may be permitted within the Shopping Center <br />are Retail Offices; <br />(ii) not more than ten percent (10 %) of the total Floor Area on the <br />Developer Tract may be used for Retail Offices; and <br />(iii) no Retail Office Occupant shall occupy more than six thousand <br />(6,000) square feet of Floor Area, with the exception of a banking facility on one of <br />the Outlot Tracts situated to the west of Wilmar Avenue. <br />The incidental use of office space used by an Occupant for administrative purposes shall <br />not be considered office use for the purpose of this Section 7.1(b). <br />GALEGAL \STORES \NE \GRAND ISLAND \OEA4.WPD <br />11/16/04 22 <br />
