Depue, <br />Successor Trustee, which Deed of Trust was filed on October 2, <br />2006, in the Register of Deeds office of Hall County, Nebraska, as <br />Document No. 200608777, herein called the Grantor, in consideration <br />of Forty Thousand Dollars {$40,000.00), received from Grantee, does <br />hereby grant, bargain, sell, convey and confirm unto Bank of <br />Clarks, herein called the Grantee, the following described real <br />property in Hall County, Nebraska: <br />Lot One Hundred Thirty-three (133), Buenavista Subdivi- <br />sion, an Addition to Grand Island, Hall County, Nebraska. <br />TO HAVE AND TO HOLD the above described premises together with <br />all tenements, hereditaments, and appurtenances thereto belonging <br />and to the Grantee. <br />Grantor does hereby covenant with Grantee as follows: <br />1. That Todd W. Friesen and Lori Friesen, husband and wife, <br />Trustors, failed to pay the Beneficiary payments which were <br />contractually due and the Grantor, at the request of the Beneficia- <br />ry, elected to declare the entire unpaid principal balance together <br />with interest thereon at once immediately due and payable; <br />2. That a notice of default was filed by Grantor on April <br />13, 2009, in the Register of Deeds office of Hall County, Nebraska, <br />as Document No. 200902737. A copy of the notice of default was <br />mailed to all parties entitled to notice including Todd W. Friesen <br />and Lori Friesen, husband and wife, by" certified mail, postage <br />prepaid on April 15, 2009; <br />3. The Trustor, Todd W. Friesen and Lori Friesen, husband <br />and wife, failed to cure the default referenced in the notice of <br />default within thirty days after the service of the notice of <br />default; <br />
