<br />KNOW ALL MEN BY THESE PRESENTS: That Ronald S. Depue, a c.:~
<br />member of the Nebraska State Bar Association and 't'rustee, upon a ~
<br />Deed of Trust made and entered into on or about May 5, 2006, by and G
<br />between Todd W. Friesen and Lori K. Friesen., husband and wife,
<br />Trustar, and Sank of Clarks, Beneficiary, and Ronald S. Depue,
<br />Successor Trustee, which Deed of Trust was filed on May 15, 2006,
<br />in the Register of Deeds office of Hall County, Nebraska, as
<br />Document No. 200604246, herein called the Grantor, in consideration
<br />of Seventy Thousand Dollars ($70,000.00), received from Grantee,
<br />does hereby grant, bargain, se4.1, convey and confirm unto Bank of
<br />Clarks, herein called the Grantee, the fo~.lowing described real
<br />property in Hall County, Nebraska:
<br />Lot One Hundred Fifty-six (156), Buenavista Subdivision,
<br />Grand Island, Hall County, Nebraska.
<br />TO HAVE AND TO HOLD the above described premises together with
<br />all tenements, hereditaments, and appurtenances thereto belonging
<br />and to the Grantee.
<br />Grantor does hereby covenant with Grantee as follows:
<br />1. That Todd w. Friesen and Lori K. Friesen, husband and
<br />wife „ Trustors, failed to pay the Beneficiary payments which were
<br />contractually due and the Grantor, at the request of the Beneficia-
<br />ry, elected to declare the entire unpaid principal balance together
<br />with interest thereon at once immediately due and payable;
<br />2. That a notice of default was filed by Grantor on April
<br />13, 2009, in the Register of Deeds office of Hall County, Nebraska,
<br />as Document No. 200902739. A copy of the notice of default was
<br />mailed to all parties entitled to notice including Todd W. Friesen
<br />and Lori K. Friesen, husband and wife, by certified mail, postage
<br />prepaid on April 15, 2009;
<br />3. The Trustor, Todd W. Friesen and Lari K. Friesen, husband
<br />and wife, failed to cure the default referenced in the notice of
<br />default within thirty days after the service of the notice of
<br />default;
